Impairment rating
#1
My wc claim is in the state of California
My ptp made me mmi on 2-14-14, it took 2 month for him to get the report done. I requested a copy of the report from my attorney. In the report he states that I have a 0% impairment rating. However it goes on to say that due to my injuries I cannot go back to the job that I was doing. That I have been doing for 35 years. He says I will need voc retraining.
I cannot reach my attorney. Can anyone tell me what will happen next?
What about my settlement?
Thanks

without explaining the restrictions the doctor's report appears contradictory and unratable.
sounds like the doctor is completely unaware of workers compensation benefits and rules; vocational rehabilitation has not been available in california for the past 10 years; they may not even know how to do an accurate AMA rating.
without a rating a settlement value is unknown
you will need another more credible report.
your atty can decide whether to use an Agreed Medical Examiner or a Qualified Medical Examiner.
you can find out more about AMEs & QMEs here (fact sheet E)

Heard so many strange thing in the WC world but for a doctor to give you a 0% impairment rating but go on to say you can't return to your job sure sounds like he has no idea what he is doing

Thank you for responding. Finailly got a call from my attorney today. At first he didn't think it was strange that I got a 0% rating and I also have work restrictions. But when I forwarded the email from my employer to him saying that they cannot accommodate my restrictions he told me that he added that in the demand letter. I just can't wait to be done with this.
Thanks again

only if you'll take a minimum settlement offer.
as your case is now it's not worth much.
