AME Deposition

Hello folks,

California Claim.

If an applicant and attorney want to depose and AME who pays for the deposition. How does this work? Any specific labor codes or CCR''s that address this issue?

review the rules and regs of the WCAB on evidence

also Labor Code sections 4620 to 4628

generally the party requesting the deposition pays.
if it's the applicant they can apply for reimbursement of their litigation costs at the time of legal resolution.

When you say apply for reimbursement I guess that means ask the judge during a trial in the event the IC refuses to reimburse.

Is that correct?

yes. itemized costs submitted to court requesting an order for payment from defendants
