injury at work or personal injury?

a couple months ago I started having shoulder pain..went to my doctor wasn't sure if it was side effect ofcancer meds.dr. did a emg to make sure it wasn't pinched nerve..it wasn't, then did an x-ray found an abnormality, said I needed mri but couldn't have that done till physical therapy, did physical therapy still not knowing what was wrong, didn't work, finally got mri and found out have a rotator cuff tear and bone spur, need surgery, doc said it was from repetitive movement, didn't fall or injur it so how do I claim it on workmans comp? I didn't injur it at work or at home it just started hurting

You will have to get your Dr to sign a letter saying it was repetitive movements and link it to your job.You might want to talk to a lawyer or 2 or 3 till you are comfortable with one and hire him/her to do the leg work for you.But try first with the note from your Dr and take it to your HR people that may be all they require
........I love cats, I just cant eat a whole one by myself......

the law does not require the injury happen "at" work but it does require that work be a cause.
if the repetitive motions of your job contributed to your condition and your doctor is willing to put it in writing then you should file a claim with your employer.

As they have said you will need a doctor to say this is because of the work you do. Now you can talk to a lawyer but you might want to see if the employer will take care of this before you hire one. If you hire a lawyer they get a part of any settlement and if your company will take care of everything once you get this proof to them it's work related a lawyer will only be taking some of you settlement. Hire a lawyer if they decide they are not going to pay for this or put up a fight to cover it
