Yikes! Pending Settlement and MSA acct.

I found Vinga's post to be helpful. It raised some new questions for me actually. Seems like were in the same boat in many ways, so I'm fine with it. These are such complex issues and each persons experience adds another layer of what's to come and how to navigate these unchartered waters. Thanks all for your input.

Totally agree with you on hoping for a larger settlement and smaller MSA, and wish I could just hand it over to Medi-care. (Especially since I have multiple body parts involved, numerous docs and want to simplify things.) However, it seems the amount is largely determined by Medi-care after they review my future medical needs. I'm going in for a final PQME soon and I'm inclined to downplay the need for future surgeries, etc.

I don't know anything about Offsets or the Harman formula and will discuss that with my atty.

As far as monies for co-pays, massages... Is that separate from the MSA funds? Sounds good since I prefer alternative care... (which isn't covered by Mcare).

Thank you so much for taking the time to reply.

I really do not encourage you to downplay your injuries to a PQME, this may hurt your PD rating and settlement. This has nothing to do with a MSA. They send information to a vendor to do the set aside, and your PQME does not have anything to do with that. Talk to your attorney first. PQME will give you a PD rating, list accepted injuries, and can discuss future medical, however PQME's cannot make decisions on medical treatment any longer due to SB863.

The MSA vendor will determine what they believe should be your MSA and then submit it to Medicare.

I would discuss donut hole type of monies that are not in the set aside, and can be used for whatever, and you do not have to submit receipts for these treatments to Medicare.

Is you attorney a work comp specialist and/or MOST of his work is with workers compensation? If so, he should be well versed in settlements.
I am not an attorney.Anything I write should not be considered legal advice.I am writing from my own personal experiences, which is not from any sort of legal background. You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.
