SSDI Offset of W/C Settlement
#1
Hello everyone, my case is in Florida. I need some clarification regarding SSDI, a W/C lump-sum settlement and the possibility of an offset.

I received a W/C lump-sum settlement in exchange of a Sign and Release agreement. My settlement (after attorney fees), was for 42K, and stipulates 23K for past medical expenses, another 23K for future medical, and 1K Indemnity. Other than that, there is no Social Security language included in the Order. Late 2012, I was approved for SSDI and, after a 8 month push back of my AOD, I began receiving benefits Nov/2013. At no time I received any W/C benefit(s) and SSDI at the same time, the lump-sum and first SSDI benefit payment were 6 months apart. Under those conditions, is my SSDI benefit subject to an offset? Also, will SSDI deduct from the lump-sum amount the 5K out-of-pocket medical expenses I incurred as a credit to me when calculating the offset? Thank you, appreciate all responses.

Yes there will be an off set.
duplicating or predicting social security's calculations is beyond my workers compensation expertise. while they will prorate the disability amount, they may not exclude the treatment $$$ that have not been used.
Reminder :
........Each state has their own comp system; POST YOUR STATE to get accurate information. Use the search feature to find information from similar questions.
THANKS FOR POSTING.

looks like all your settlement went to msa so if anything your ssdi should increase after the 1k is offsetted. i dont think the medical $$$ is to be offset - someone correct me if i'm wrong
