1171-When Can You Re-Open case
#1
Hi 1171! Remember me?Tongue What is the criteria to re-opening a case? And after going through my case file, I noticed that I was never I could file a Civil Suit to my employer at the time...can I do it now or is it too late. I never got a notice of termination (ever) I had to call my employer last year to find out if I had any life insurance policy... that's when I was told I was never terminated...So the lady said "Interesting, they never sent you a letter, I guess I should send you one right away." She never did LOL
What do you think of my questions?

yes but not your state.
are you in california? each state is different.
I assume you mean for more disability $$?
I'm not sure what the basis of a civil suit would be.
I don't think they are required to terminate you when you don't return to the job.

Hi 1171... Just to let you know... I spoke to my PM Dr, and he was adamant about turning down the buy out... and I called people I knew at the hospital (previous employer) and figured out what the current dollar figures would be for surgery, PT, meds, and treatment and I figured there was NO WAY Work Comp would cover the amount of money I would need... So I called my Atty and said "No thanks but thanks for asking!"
