Quick question about Lumbar injury, rating, and state disability
(10-27-2013, 01:19 PM)Frayed Wrote: Hows it going guys. I'm new here. Just posted about my settled case yesterday however I have a question for a friend. He had a lower back injury at work. He switched jobs awhile back, about 8 months because he couldn't do it anymore. It wasn't restrictions from a workmans comp doctor because they wouldn't aporove him. It was his own doctor while using his work health insurance that he had. Because of that he was on state disability for 6 months. Workers comp finnaly approved him last month and now is at physical therapy. He has a new job now too and yes he has a lawyer.

Here are the questions, mind yiu this was in new Jersey and still is.
Does he gave to pay that state disability back out of any settlement he would get?
And if so does he pay every penny bsck or a percentage?

What are the typical impairment ratings for a few bulging discs in the lower back and one in the neck? Also has degeneration. I know there is no average but what in your guys experience is the rating for Lumbar with just bulging and degeneration if he doesn't get any better. I heard Lumbar is usually a low number . Any average numbers or experience would be really appreciated. He doesn't need surgery.

Thanks so much for yiur time. I'm trying to help a good friend get through this as workers comp really put him through the ringer in the beginning.
I had something similar. I was on restriction by worker comp. I was sent to a specialist that said that I needed surgery. Of course worker comp sent me to get a 2nd opinion. The second doctor ruled against the surgery but never gave me a note to go back to work full duty. I asked my personal doctor and he agreed with the 1st doctor that I may need surgery or look for a different job field. His only worry was that they wanted to do a spinal fusion and he told me that, that can be risky.

I then got a 3rd opinion from another spine specialist and he again agreed with the 1st doctor and my personal doctor. He however suggested a laser surgery.

I had the laser surgery and because the WC refuse to pay because of their 2nd opinion I had to go on state disability. I was told that if I ever get a settlement that I would have to pay everything back.

While we went to trial and I did receive a settlement. I was told by my lawyer that I will have to repay disability. However my lawyer had but in our settlement that the WC repay the disability and any out of pocket cost I had from my surgery. Of course the WC fought it but the judge had agreed with my lawyer and they was order to repay the state for me along with any out of pocket cost. My lawyer also got them to let me reopen my case again within 2 years. (this was my 1st re opener)
