settlements/mmi/fce

has anyone waited so long (sounds silly i know) for a lawyer and IC to come up with a decent settlement, that during that time one may have healed or improved greatly therefore rendering the previous fce moot? hope i am making some sense here.
could that person request a new FCE after being declared MMI?

disability benefits and settlement amounts are proportional to impairment so it doesn't make obvious monetary sense as to why you would.
