My attorney had contacted me a little over a month ago to inform me that my case was going to court for a pre-trail hearing. He inform me that he had given them his demand but we will have to see what happens in court.

Once at court the WC lawyer had told my attorney that they was not ready & he had forgotten to bring my case file. The date was postpone for about 2-3 weeks.

Now at the second hearing the WC attorney had requested a conference with my attorney and the judge. My attorney had told me that they wanted the judge to consider a fair settlement.

Does anyone have any idea what may happen?

Here is a short version of my case. This was a re-opener from an injury from 2008 where I had injured my back. At that time I went to PT for about 2 months. I had a settlement and was told that I can re-open it within 3 years.

About 5 months after I went back to full duty I started to have some pain returned. I requested to go back to the doctor. Calls from me & my attorney to the WC went unanswered for more than a year.

After six months I went to my own DR. since the WC never got back to me. Finally about 6-7 months later the WC contacted my & sent me to their DR. Their specialist said that I needed surgery. This is also what my Dr. said. A few weeks later they sent me to another Dr. to get a second
Opinion.

I then got a third opinion on my own and he had agreed with my Dr. and the first WC Dr. said. I went and had laser surgery. Not to mention that their second opinion Dr. never gave me a note to go back to full duty.

Worker Comp does not want to increase my disability because they do not approve my surgery.

I suspect the conference is to try and get a setlement amount.
If it doesn't settle not there will have to be a hearing to decide the benefits.

Case is settle for 53K. After lawyer, doctor and state fees for disability payments I will take 32K with option to reopen in 2 years

thankx for the update.

I'm sure it less then you expected but it's nice that there is an option for coverage if things go terribly wrong in the next couple years.

Yes it was less and to make it worst I was told that the settlement was base on 180 weeks (I guess payments over 180 weeks) so I may get it in installments.
