Settlement Question Please Help!!

First off, love this forum. Lots of good info on here. My question is this, I was hurt over a year ago. I am still not MMI and that is strickly due to the fact that in Ohio, the minute I am MMI, I will be cut from all payments and since I'm a single father, I can't afford to have no income.

I advised my attorney 3 months ago to please start the feelers for settlement. He said he would send demand letters, whatever that means, and I have heard nothing back. Is it normal to not hear back about any settlement offers at this point? Also, is the MCO and IC waiting for me to be MMI and cut off of all money so they can low ball me? My BWC doctor today when asked told me my disabled rating is total. He agreed with both IME Dr's that I'm "done" when it comes to physical labor. Since I can no longer hold a CDL because of the meds I'm on, and I have no other education, I have no choices here.

Should I call my attorney and DEMAND he work on settling?

generally your future disability can't be accurately estimated until your recovery is finished and you've reached MMI.
that maybe why they are not ready to talk settlement.
your atty can't make them buy out your claim.
carriers are often more willing to settle when they face a court date.
but as long as you are not at MMI and are getting benefits there are no issues for the court to resolve.

If your Drs are saying you wont be able to work again and you are a single father of 3 you should go and fill out paperwork for SSDI at your local SS office this can take up to 2 years to get thru depending on your state and age.....so you might want to get the ball rolling now.You can start the paper work on line
........I love cats, I just cant eat a whole one by myself......

As Jayne said if you can no longer work get your SSDI started it. If you are just done with labor type work and can do other type work then you might want to wait. Age could come into play depending on what is going on for you.
