CA-Medical Mileage Reimbursement

California-Submitting reports for medical mileage reimbursements repeatedly to insurance company (now 180 days old) without response. They ignore every request completely. This all started 7 months ago. I used to submit the form direct to the IC and would receive payment without an issue. Now they just ignore them. Adjuster won't talk to me since I have an attorney. Attorney just blew me off on this and won't do anything to help either. Complaint filed with Audit Dept in CA but they just track complaints and nothing is done. Any help out there?

you can write a complaining letter to the claims manager or contact your employer who may have more clout.
other then that keep documents of when you sent and when you get a court date include penalties in the issues.

I have written the claims manager letters; always professional and courteous. They just ignore them. My employer doesn't have any clout (and also changed carriers for comp coverage) so no leverage there and they have been completely hateful in this entire matter since they didn't want a claim filed to begin with. My lawyer refuses to request a court date on this or the medical issues IC keeps denying despite the AME reports and stipulated settlement of medical open, prescriptions that never get filled, etc.. So in a nutshell, I am screwed. Thanks for the reply.

you can try changing attys.

Appreciate the replies. Frustrating that a simple matter such as mileage has to be drug in to court. WTF is wrong with these adjusters? They just want to play games and mentally screw you over even further by not paying the mileage as prescribed by law. Since there really is no recourse by the IW, what the hell do they care?

There really isn't any money in my case that would get another attorney to take it on. My case was settled with a compromise/release, leaving future medical open within the scope of the AME reports. However, everything within the AME reports that my doctors have requested for treatment have just been denied or ignored by the IC's UR folks. EVERYTHING! So much for "lifetime medical." What good is that if you can't even get a damn prescription filled without going to court!

Had I known how WC works, I would have lied and told my own doctor the injuries were my fault, and used my PMI coverage and just gone out on disability. Since my injury, my PMI has been gutted by my employer leaving me essentially uninsured so I now have no access to any medical care whatsoever.

there can be a lot of penalty $$ -- each delay is a separate penalty and multiple penalties can result in a heavy fine.

Hello Just checking in to see if you ever got your mile reimbursement?

I was receiving reimbursement and now it has been ignored as well workers compensation adjusters will lie to me saying the check is in the mail

I did finally get reimbursed. I filed a complaint with the audit unit (link here:  http://www.dir.ca.gov/dwc/Auditref.pdf), copied this to the adjuster repeatedly (once a week at least with all the docs to backup my reimbursement requests) and finally got them paying again. The audit unit in CA is pretty much toothless. They just take in the complaints from workers. They don't really do anything directly but it does sometimes get the attention of the adjuster when they see your complaining to the DWC directly and your attorney if represented.
