After the argument and all the briefs filed by the IC's attorney the ruling was finally entered by the judge on the motion to dismiss our 3rd party suit and he DENIED it.

Now I guess we wait for the WC mediation to see if they were serious about wanting to settle both cases under one blanket settlement. I personally believe if they want to attempt to settle both, they will start negotiations before the mediation and not wait till then. I figure they will stall as long as they can and in the meantime we still prepare for trial on both cases. This is just a small victory against the IC but we will enjoy it for now....

Hey we have to enjoy any victory we get. Congrats and hope thing go your way in the end

We are all happy we are at least near the end. My ic asked if i would settle, we gave a low offer,and they came back w/ a lower ball. Really if we were in court they would lose alot... But my att. it suggesting the judge rules low, in her favor it would work to have that lump sum. But my family has been thru alot and I have to consider my dis rate. and med future. we thru 57 and they 37
May my personal experience help others. No question is stupid.

ammowoman, It may seem like a small victory but it will set things going again.. congrats...


After another week or so of my attorney being ignored from thier attorney, a letter was sent out yesterday giving them untill the 18th to respond with intent to settle and to address our latest counter offer.. If no response by the 18th he will then proceed into court and render the judges decision per clients best intrests..

Even after the state got involved, they still insist on playing thier games and I'm sick of it.. I asked my attorney to just get a court date set and i wont agree to cancle this one.

I'm not sure if his case was ever moving. Its been a very slow process. Now that we are nearing the end, small victories are nice to have. The IC's lawyers were getting upset and aggressive with our specialist in their depos trying to get them to contradict their findings in their reports. That didn't happen. It was their specialist who contradicted them self in their depo last month, agreeing my husband is unemployable from his accident. Now with the denial of their motion to dismiss, we will sit and wait for another mediation to be scheduled.

Bronco, I hope you get settled soon. They will stall. There is no need to wait for all these court dates except to prolong the inevitable.
