Overpayment workers compensation

I was injured last year April 2012. I missed work for a month. I returned to work within the first week of May. I received my last check in may, 6 months later, I received a letter from my adjuster saying I was overpaid 2 weeks of may of $580. I ignored the letter until recently i received another letter and a check (first check since I returned to work). The check was for impairment income benefits, they deducted 20% of the overpayment from that check. I now owe 471 and the check is for $396. My question is whether or not I should cash in this check, and if I have to pay them back? I am a full time college student and can not afford to pay 471$.

no you don't have to repay the overpayment.
yes you can cash the check.

Ari, do you have a attorney.. Probably not, since it was just a short time you were out.. To send you a impairment check they must have given you a impairment rating.. I wouldnt give it back, its probably thier way of screwing you..

What had happened to me was I was collecting ttd and they sent my file to one of thier drs for a ime. I had allready had an ime and raitng done and the value was 48,000.. They did my review back in dec 2010 and thier dr said I was mmi and it was feb by the time his report was finnished.. Wc was paying me ttd durring the time the report was being done and they claimed they over paid me 2 1/2 months and was just over 6,000 so they deducted 6,000 from the 48,000 and stopped the ttd and started paying me ppd.. It's not illeagal, just a difference of oppinion that would take a judge to resolve..

I dont know the amount or what you injured, I'm just afraid they may owe you more money for your impairment, and they are pulling a fast one..

not disputing your opinions, but if they are already taking money out at 20% each check for overpayment, why in your opinion does he not have to repay,,,,,, just interested

I mean it literally.
they can re-coup out of any future disability owed but he doesn't have to pay out-of-pocket

I'm not receiving anymore checks, that's why I'm wondering whether or not I should pay.

In Florida the IC can recoup at 20% of future payments. If you have no future payments. They lose. You do not have to pay anything back. (FYI. I was a Florida adjuster at one time)
