Light Duty Denied Help!
#1
Sad
I live here in California, and I was returned to work on modified work. After the Doctor's office had faxed the Doctors' note, my employer contacted me and said she had '...no light duty work for me...' and '...wanted me to 100% ready to work...'. Now, I was told that if your employer has no 'modified work' for me; even though I want to work...my employer has to pay me my full pay. I've tried soooo many sites about this, but cannot find an answer. I need help.

comp makes disability payments usually from the insurance carrier - not payroll or wages. you won't get your "full pay" from your employer.
disability depends on if your restrictions are temporary or permanent.
if your doctor says your limitations are permanent(you have reached Maximum Medical Improvement), then you are entitled to permanent disability payments. the carrier will make advances while the rating is calculated.
if the restrictions are temporary, then contact the carrier and your temporary total disability will be restarted.

In NY you can get unemployment if you have doctors orders for light duty but your employer doesn't have work for you. Check with California unemployment. There is a 1 week waiting period here in NY but at least it's something because the employer doesn't have to pay you anything.
