mmi for one body part and not the others

I was injured in California, 6/2/2009, I tried to work out the pain and then said to hell with it I couldn't do it anymore,

I read on here before I registered, about this, but it says when I do a search not there, so I talked to my adjuster today and she said I couldn't be mmi for one body part and not the other, when they accepted the PR-4 over 6 months ago, and didnt like my doctors PR-2 report for my neck and thoracic area, so now they want to have a QME, when my doctor wanted one a year ago because he wasn't a spine specialist, now all of a sudden they want a QME for everything, and I am not going to allow it for my shoulder, because they had 90 days to disagree with the report, I will have an appointment with a attorney on friday, because now they are changing the way they are dealing with me, so I am going to change the way I am going to deal with them

of course you can--it's rare that they happen at the same tiime.
MMI is a term describing medical healing and recovery. different body parts heal differently everyone knows that---even an adjuster.
you must be confusing an MMI determination with a permanent disability finding.

When a injured has mutiple injuries they cant predict you will be mmi for all of them at once... This is just a ploy/game they play to stop bennifits and has happened to me.. Sure they can get there quack to say everything is at mmi, but this is when a attorney is needed to prove thier drs oppinion wrong.. Your hands are tied, if they want the oppinion on your shoulder they will get it wether you allow them or not... You can change the way you act to them, but frankly they dont care... Get legal advice...

nah she said mmi for the whole body, she specifically said that, and I said no she cant disagree with a report 6 months after the report was written, and she said she could, and I said good luck with that, I just wanted to here I was right about the subject, that is all, It is good to hear your right once in a persons life, lol
I have my report and the date it was reported to them, and I didn't receive a letter of disagreement, and the doctor, their doctor will stand behind his report for me, he says I have been given a raw deal by the IC, and I am meeting with a attorney friday morning because I am not trusting them at this point, guess I never should have

got my lawyer, he said he was going to cancel the qme I have scheduled, because I would not like the out come, and look at getting a new panel, he seems like he is on top of all the terms and read everything I had while I was there, took his time and was conscious of my feelings and concerns, no rushing like some professionals do, he is on the super lawyers list, which made me feel good, why I don't know, he was also concerned about my thoughts, because I said a few things, that made him feel I wasn't comfortable with my being hurt and not being able to do my job anymore, so he is going to push for me to see a therapist, noticed a little depression about my plight, anyway, I am just posting my thoughts because this forum is here, whether anyone reads them or not, gives me an outlet to do so,

1171, went to a AME a few weeks ago, can the IC disagree with the findings on this report also, I am sure they can just was looking around w/c web site
and could not really find the answer

yes technically. they just can't use another doctor's opinion.
if the facts are wrong, medical history is incomplete, tests and data missing and conclusions are unsupported, they can take it to court and try to have the judge throw out the opinion. AMEs are not perfect and can make mistakes.
if they are going that route generally they will schedule of deposition of the doctor to try and get them to contradict themselves or admit errors.

well got a call from my attorney yesterday, since they have been not paying me for two months because my pain dr was thinking my visit was a consult only and wouldn't send a report of my work status to the IC, finally got my old dr to report to IC and got my Ame dr report which says I should have been off the whole time and seen my new pain management dr which finally agreed he was assigned as my primary since march 5th, and sent my status to the IC which said I should have been of since april 22nd, and filled out my state disability form from april 22nd to august 2014, anyway the lawyer and said he had a offer and they offered me a large sum, and of coarse I said no, my neck and back are killing me and I need surgery, my ortho said I will need future surgery on my shoulder, and and no offer of future surgery and if my ssi comes through they would take most if not all that money for medicare, they just need to pay me my two months of ttd payments, if I dont hear from them by tomorrow my attorney is going to file for a emergency hearing with workmans comp, did I say I hate workmans comp

yeah, but as bad as it is it's still got to be better then not having comp.
workers without some outside resources or assets and $$ are very vulnerable to job loss &/or serious injury.

without comp -even as bad as it is - you could be years without anything until a civil trial could be held.

when you lose something it always feels/seems worse then if you never had it at all.
you gotta realize it just a matter of perspective; and don't let it get you down.
try to adjust and focus on what you have rather then what you've lost.

adjusting your attitude is the key to surviving difficult circumstances.
at least that's what I see from others who have gone thru extremely trying situations.

just trying to offer some encouragement.....

thanks, I try, but they try to starve you out, and they dont know I have been through this thing they call bankruptcy before, I came into this world with nothing and I'll leave it with nothing
