Emergency Hearing this week State of CT
#1
I am scheduled for an Emergency Hearing this week in CT, I have been out of work wth a back injury from a fall in Dec.
Insurance denied the claim stating the injury was preexsiting,
What is the outcome of these hearings? Will I get my back pay that is owed to me? Will the insurance company take care of the claim?

the outcome depends on the evidence presented.
the appeal can be denied, accepted or carried over for further evidence.
if your appeal is granted, it does not guarantee retro disability payments.
you would have to present disability information from a doctor.
each type of benefit has it's own requirements apart from whether the injury is accepted.
Reminder :
........Each state has their own comp system; POST YOUR STATE to get accurate information. Use the search feature to find information from similar questions.
THANKS FOR POSTING.

Many have been in the same boat. 1171 said it best it will depend on what is presented at the hearing. All the out comes he listed are possible. You could walk out of there with a ruling in your favor but that does not mean they will not appeal it and you could lose in the appeal. If they are wanting a depo I would say they may not make any ruling at this hearing and may wait for these depo's. Sorry to say its pretty much impossible for anybody to say how it will come out. If you have good medical evidence then there is a good chance you will get this covered under WC but again a good lawyer can make or break a case.
