Getting a job on 100% temporary disabled through NYS comp
#1
I'm not sure how to word this question, but here goes.

I am on NYS Workers Comp for a rotator cuff injury. I had surgery on Nov 13th 2012, and am considered 100% disabled until I meet with the Doctor on March 5th 2013. During this time I am seeing a Physical Therapist 2 times a week.

If I were to get a job before March 5th, would it affect my comp payments? Would it affect my 100% disabled status? I was under the understanding from my lawyer that I would not have to find a job until after the Doctor saw me again and made a determination on my Physical Therapy Rehab's progress, but now I have someone telling me otherwise, so if I can go find a job now without any Comp repercussions, I would like to.

Any takers?

If you are considered 100% td and are collecting bennifits, you cant work until your dr relesaes you.. You can do it but you would loose your ttd checks, you cant work and collect 100% ttd at the same time.

only if you accept temporary disability payments for the same period.
if you go against your doctor's restrictions you could set back your treatment which could also cause problems with your benefits.
best to discuss it with your doctor and get a restricted release and notify the carrier of your additional earnings.

Reminder :
........Each state has their own comp system; POST YOUR STATE to get accurate information. Use the search feature to find information from similar questions.
THANKS FOR POSTING.

Thanks!

I spoke to my lawyer this morning and he said the same thing, I either have to wait until my Doctor clears me, or I can ask the Doc to clear me early and yes it will affect my comp payments

pretty much the answer I was expecting
