Dr said I can go back to work
#1
I saw my neck surgeon that I've been treating with and since I decided to wait to take the neck surgery, he would put me back to work, well I have to start looking for a job, because I can't go back to what I was doing before he said wich was costodial work and my doctor for my shoulder said MRI showed arthritis, I'm also treating with a pain management doctor I have my good days and bad, so the question is wene I do go back to work( wich my injurys are cervical strain herniated disk in my cervical and impingement on my left side of neck, I'm decided not to take that chance with surgery) wene I find a job does this means I reached mmi and the ic would want to settle what happens next because I still would have injury for life and what would they offer slu or monetary damage award what would I expect next from the ic lawyer takes his time calling me back because I have some questions for him

MMI isn't based on whether you are employed are not, it's based on whether they think you are at maximum medical improvement ( basically there isn't more medically they can do for you at this point ).

Settlements don't always guarantee money and if they do its based on ratings and your class of work. Your attorney has the best idea of what your settlement would look like, each case is SO different.
I live in CA, it's not always sunny... And the Workers Comp sucks! Smile

Future benefits depends on your state rules.
We need to know your state before we can provide accurate information.
Comp benefits are not based on damages - but impairment or wage loss or a combination.

the spine is not considered as a loss of use part of the body.
you would be eligible for a standard impairment rating.
whether the employer/carrier would want to buyout all your future benefits or make periodic payments and leave the medical open probably depends on the settlement amount.
