Help! My attorney turned on me and i was coerced during mediation SOUTH FLORIDA
#1
Had mediation today and my lawyer, who promised to get me a back surgery from the start, started pushing me to take the lower offers from the insurance company. When we got up to around 25,000 they said they had nothing more and I said i couldn't get a surgery with it. I was threatened - said my pain management doctor would keep me in pain for a couple years, etc... I agreed ONLY to receive 90% backpay and medical bills covered.
Who's gonna help me?
Do I need a new lawyer for a status conference hearing?
I swear on everything that I hold dear to me. Honestly, I was injured while working and I do have constant 4 or 5 out of 10 back pain. I will start contacting other attorneys myself.

yes you need a new lawyer.
you should write a letter to the court with copies to attys of both sides that you were mislead and misinformed and do not agree to the terms.
you need to file a complaint with the state bar.

I have had a full night's rest and I can see I little more clearly. I'm in neutral right this second and am thinking that my lawyer AND the mediator, who may have have ganged up on me, can still bring me some justice for my injured back. Do I want to start a freaking crusade over a back injury? Everyone deserves second chances.

Regarding the previous post...I just spoke to an attorney and found out that what I signed does NOT settle the case. HOWEVER, I was still pressured into taking lowball offer from both mediator and lawyer AND pressured to sign a statement.
No more panic mode. However, I still need a half-decent lawyer that will look out for MY interests.

Yes, you need a decent lawyer to secure your medical needs.. I would write down what you want and have a sit down with your attorney and stand firm.. I would also do as 1171 suggested by writing a letter to the state bar and inform them of the treatment you are recieving by being presured.....

Well, I called the Florida Bar and first tried to mediate with my attorney via one of their senior attorneys. No apologies. I believe a formal complaint is being mailed to me.
I wrote a letter first thing the next morning, had it notorized, and, when I finally found what judge would be in charge, faxed it to her assistant in Talahassee to have the document filed. It's basically a timeline of what I believe happened to me during the mediation, including the mediators own ill will.
Now I'm trying to find a lawyer that is nowhere near this area to help me with the matter. I am getting some legal advice now, however this man does not do workers comp cases. An old friend, though.

I just found that my motion to cancel the mediation agreement has officially been filed. Now I have to wait for the Judge.

Oh, and by the way, now this attorney is accusing me of doing all of this from the start. All I wanted was a surgery. Jeez. He thinks I'm smarter than I really am?
