Pre Injury Wages
#1
Do any of the attorneys on here now the formul used by SSDI to determine a persons pre injury average wage. They would use this
formula to determine wc offsets. Since you can only cap out at 80%.

I think I read their is 3 different ways to figure it, and they use the higher of the 3 for determining the cap.

1. prior months income
2. previous 5 years income prior to DOI including the month of DOI. THen average out per month
3. Highest 10 years income . Then average out per month
Then they use the higher of the 3, and figure the 80% cap from this number.

Does anyone know if I am correct on my formulas???? Will SS provide me with how much the amount is and which method they used to come up with the numbers???
