Hello all,

My injuries were to my respiratory system. During a deposition, my WC assigned physician stated that he won't assign a rating because he believes I will be better soon or that my condition can be corrected with sustained use of medication (more than likely for the rest of my life). If I have to take meds for the rest of my life doesn't that equate to the organs suffering from some form of permanent damage? I'm still trying to understand this process. I'm in SC.

Thanks for any enlightenment you can provide.

whether a rating can be done on corrected or uncorrected impairment depends on the rating standards and guidelines in effect for your state.
what guidelines are used for your state?
you might have to discuss the question with your atty.
the doctor should give a rating for uncorrectable impairment and let the let the legal system decide.

Thank you so much for the help. Sorry it took me so long to follow up. I had a talk with my lawyer and he stated that if I have to be on medicine to help me open my airways on a consistent basis and if I wasn’t in this state before my injury then my lungs are functioning at a diminished capacity. He told me that he would send me his specialist along with my records and have another doctor determine a rating. After that we will probably have a hearing with the other side and it will be hashed out from there.
