uncooperative and fustrated...

Okay so Ill start of by saying that i am in california. My injury happened on 1/6/11.. the injury consisted of me feeling a pop in my left wrist (i am left handed)... went to the company dr. they didnt do xrays or mri just a splint n put me on light duty (sitting in a room doing nothing) seen a hand specialist took mri on 3/3/11 and said i had ligament tears then he casted me 6 weeks then requested surgery it was denied...the company told me i need to get a second opinion that specialist took an additional mri 5/11/11 and he said nothing was wrong old tears....now i am deemed p&s as of 5/31/11 stopping the workers comp. payments the company dr refused to give me the fitness test my work requires to return to work but offered to put me on disability in the meantime.... well the 6 months of disability are up and the dr is saying that the disability was a one time thing and wont renew it and he is not approved to treat me anymore...my lawyer told me to take a letter to my work saying for them to either send me back to work or allow me to see the company dr. they refused both until i see a panel QME which they havent allowed me to see either (upon delivering this letter I was hoping that they were going to let me go back to work, I want to go back to work an I feel I can do my job) . My lawyer filed for a court mandate to see a QME...so in the meantime are they allowed to not give me any type of benefits? What can i do, everyone knows bills do not pay themselves... Fortunately for me i explained my situation to my primary dr and he fiiled out the disability forms but shouldnt i be on workers comp not disability. I am only making 1400 a month versus when i was working i was bringing home 2400 a month...I cant take it anymore....

how are they preventing you keeping your QME appointment?
they are not required to pay benefits in dispute when the issue is still before the court.
undisputed benefits should be paid and brought before the court if they are not.
benefits denied by comp can be obtained under your health plan who can file a lien with the comp court.

they arent preventing me from keeping my appt they are keeping me from even getting a dr. we requested the AME my lawyer told me they said that there was no way they were going to allow me to see a AME so we filed for a panel QME which i believe they have 90 days to provide? which they did not provide so my lawyer filed for a hearing so that the judge would force them to give me the QME panel...so they are allowed to just leave me in limbo until the hearing?

The QME panel is provided by the state not the carrier.
there can be waits both to get a panel as well as a court date.

benefits have been denied. you are appealing.
it happens to both sides all the time in the legal system.
