Hi Everyone! It's been a while since I've been here. Hope all is well! I finally settled my shoulder claim in March...unfortunately I also lost my job due to the restrictions. I also cashed out my voc rehab shortly after. My employer did not actually terminate me from their books until 6/7 but my last day worked was 2/9. My question is this...
Can I still qualify for Unemployment Benefits even though I received a lump sum settlement? I went on-line to file but it said I had to call and file by phone because I checked that I had received compensation for a job injury within the past 18 mo. I am unable to locate info on the NV site. I'm still searching but if anyone can help I would appreciate it.
My income and base period are not an issue.

Yes, as long as your disability is no longer temporary and you medically work.

The disability benefits you received while out on WC will be considered as "income" for the purposes of calculating the UE benefits. The lump sum was an indemnity settlement (compensation for the injury / loss of use) and not for lost wages. The indemnity would not likely be taken into account for UE calculations.

i can't answer for the state of Nevada UI, only for the comp portion; having a comp settlement doesn't disqualify you.

Question for NV worker: What do you mean you cashed the voc rehab lately? Did you get paid for the voc rehab? I am asking you this because when i asked my attorney if I can have voc rehab towards my settlement I was told it can not be done - either I do the voc rehab or if I don't do it it will be against me.
