C-8 says I owe money back ???

Hello everyone, and thank you in advance for any input you may have.

It was a little unsettling to get this in the mail today. Being the weekend, I can't ask my attorney. I have a call into that office. But I'll give the short version of these recent developments...

WC injury in February 2010. Back and forth with IC, hired lawyer, filed for hearing, IC finally started paying in August 2010.

PTP has had me at TTD from day one.

October 2010, sent to IME. IME says 'mild disability'. ER offers LD. Attorney suggests to 'give it a try'. I find that the max hours I can work (before pain is unbearable) is 5 hours.
PTP says, "Ok. 5 hours max for at least next three weeks". ER sees PTP recommendations and says, "Go home. Need you for whole day"

IC picks up TTD payments again. March 2011, ER says, "Hey we have LD for 5 hour days". So I go in and work 5 hour days.

IC has a supervisor on my case now. A copy of the C-8 comes in the mail today. Showing the time I should have been paid for and what they've paid out.

Time paid for shows as February 2010 to October 2010.

What it shows they've paid out is from February 2010 to March 2011.

And there is a negative balance for $X,XXX dollars (the difference between October 2010 and March 2011).

It's a negative balance. Are they claiming that I owe this money back, and that I've been overpaid ????

Any input and advice is greatly appreciated...

I had this question posed on another WC website as well. I was hoping for additional input here. I copied and pasted as I didn't want to leave any details out.

What is your 'yes' referring to ?

i think the letter documents the periods they believe disability is due and the amounts they have paid -resulting in a negative balance or "overpayment".
whether you will have to pay it back is unknown.
the disability issues will have to be part of the legal resolution of your claim.
make sure your atty has a copy for their file.

Thanks, 1171...

My feeling is that the insurance company wants the money back from when the PTP suggested limited hours until last payment.
But the employer sent me home because they "couldn't use me part time". That didn't make sense to me, as I was doing a job that was NOT time-sensitive. And I have the emails where the facility manager states the above.

My employer is self-insured. Don't know if that plays into things in any way. But if the employer is the one that sent me home, why am I on the hook for any payments following that ?

Any input and advice is greatly appreciated...

i don't know enough about your case.
make sure your atty has a copy of the emails.
TTD is not due once you are at maximum medical improvement.
