I understand that IC dont have to settle but do they usually try after MMI. I've been released by my doctor for a couple months now. My rating for my compound fracture to my lower leg is 33% and im in the state of GA. The IC is **name edited by moderator**. My lawyer sent a settlement letter a month ago sayin that we would like to try and settle. He said their total exposure is around 160k and thinks he could get it to around 75- 95k. My doctor says I will never be able to return to doing the same type of work I did before and the IC has made no move to try to put me in a job that fits my needs. I guess my question is that if the IC has not responded in a month now to the letter my lawyer sent does this mean they dont want to settle?

all it means is they are busy,not interested,gonna send you to another Dr that may dispute the rating,any of these

probably means they are not in a rush to settle for whatever amount your atty demanded.
get a court date and that'll generate some response.

i just went trough this process with the same ins comp. hang tight my lawyer did the same and it took about 2 months to hear back. we said no thank you to the first offer and yes to the 2nd offer last week. **name edited by moderator** wont jump when you ask them to but dont give up hope.

Thanks that makes me feel a little better, I just hope they get it done soon. My weak little WC weekly checks are putting my further and further back on bills. My only worry is that I was actually injured by a third party that we have a lawsuit against and I dont know if their gonna want to settle until that cas is resolved. But im keepin my head up. If you dont mind me asking did they try to low ball you bad on the first offer? Like I said my lawyer demanded 130k but tryin to get it to around 75k plus. What happens if they cant agree on an amount?
