open medical pros and cons
My (left shoulder) workers comp. case has been closed for more than 3 years and I still have open medical. What I'm trying to find out is, if I sell my open medical back to the insurance company say for $20,000.00 will I have to pay the first $20,000.00 of my medical bill even if the bills are not for my left shoulder. My SSI layer said I might. So am I better off just keeping the open medical or what???

In my humble opinion, this is a question only you can answer.  Keep in mind that every workers Compensation claim is different. So, the pros and cons would vary from claim to claim.  My answer to you would be it depends on how you feel physically and no one can answer that but you. Do you feel that like you will need treatment in the future?

I ask to leave my medical open but my attorney says they with do a set aside with social security. I live in Illinois. The insurance company is trying to settle but the first offer was low my attorney is trying to tell me because I didn't make a big hourly wage at my job it makes it lower. My case is whole body, I hurt my back. I looked on the Illinois work comp web page and it says its not just based on wages. I do not trust my attorney to tell you the truth. I have just now signed up for SSD and my attorney is saying if it went to trial it would hurt my SSI case.
