ct 2nd voluntary agreement after a surgery - deborah foss - 10-19-2017

CT I had received a voluntary agreement amount of 14.5 percent (an average of 12 and 17 percent). Then I ended up having surgery (l4-s1) fusion. Now two years after the surgery my back has fused. MMI done and total back percentage is 25%.

I just received a voluntary agreement form that says they will pay me 8% because they are subtracting 17 percent from the 25%. Since the previous amount was an average. But I only received the 14.5 % money?

I am confused, this doesn't seem right as I will not receive 2.5 % of my impairment

Also, my doctor will not release me to work as he says I am disabled. So how can I be on PPD.?

Anyone in CT that can explain this to me?

Did the doctor that did the 25% rating do either of the others ?
Sounds like its a negotiation with the carrier/employer. if so, they want to give the least.
Tell them you are willing to give them credit for 12.
...a sillly game that will end up with a split again.

Permanent disability applies to all possible jobs; not just yours. "Permanent" refers to the duration of the disability not to the extent or amount.
There are levels of disability; you are not permanently totally disabled from all jobs/occupations-- only permanently partially disabled from some jobs.

No the 25% was three different doctors post operation.

The original 14.5 % average was 3 or more years ago with different doctors.

I just got a letter in the mail. My union rep has filed for an informal hearing for me. Yah.
