So many questions and what ifs in sourh dakota - Dontworryaboutit - 03-16-2017

Hi all we are just looking for imput on our situation.  My wife's Brachial plexus was injured during shoulder surgery for an injury at work.  Fast foward 2.5 years we are looking at a possible mmi rating and had a FCE test as well.  Fce test said that she is reccomded to sedentary work.
Hoping to get a discussion started with these questions.
1.  Has anyone had an injury like this and what did they try to settle with.
2.  What will they rate her on just her hand or will they consider all injured parts like the neck, wrist. Arm.
This is just the tip of the iceburg.  Weve had several appts at mayo clinic.  Thanks for reading

1. Each state pays different benefits; settlements/ratings are not comparable even for the same injury.
It's not the injury that's rated; its how much function the guideline calculates has been lost after maximum recovery.
there have been thousands of back injuries over the years and rarely have any workers received the same amounts. there are too many variables (wages, date of Injury, benefit maximum, future earnings loss, rating, vocational rehabilitation, age, occupation, education, etc.) to make meaningful comparisons between injuries. even the same person with 2 separate back injuries will get different amounts from each.
2. All the body's  systems that are affected by the injury are rated and combined.

An FCE will not be used in a rating; it's often used to measure recovery progress or for vocational rehabilitation.
South Dakota uses the AMA 6th edition guides for impairment rating. Your wife can ask her doctor about the various measurements that will be used in her rating.
she might even be able to find a copy in the library or at a medical school.

Glad that was helpful. Looks like we answered the whole iceberg. Come back again.
