Work Comp stopped payments unbeleivable lack of knowledge - rps - 11-13-2014

On July 14th I was laid off at my employer as part of a reduction in force. Prior to that I was on work comp full time up until Jan 3, 2014. At this time I returned to work on modified duty and half time hours. I stayed on modified duty up until July 14th when as a result of a reduction in force I was laid off. Also on July 14th Work Comp stopped the supplemental pay for half time to make up the difference between what I got from my employer and what i would get if I were getting full time work comp benefits. At that time Work Comp started to pay against what I might get as a settlement. When I asked my work comp rep why I stopped getting paid I was told that they did not have to pay me because I had been laid off. My attorney told me that is not true. I also found out that I was not at the maximum time of 102 weeks collecting Work Comp. The defendents attorney said it was because they had not had a report from my doctor as to my status. I went to my doctor and had him fill out a report which I gave to my attorney but still have not received any pay due to me. What can I do to get Work Comp to pay me the benefits to which I am entitled?

have your atty request a hearing before a work comp judge to rule on your entitlement.
have your atty file for a penalty.
depending on your state you may have alternative benefits available.
