MMI Appt for Rating - bluewolph13 - 08-27-2014

I had an MMI Appt with a Dr but forgot to ask him how long it will take to receive a hip fracture (nailing) rating in South Dakota. I have no idea what to expect. I broke my hip last July 2013 on the job. I received WC until Feb 2014. My last appt was with a Physician's Asst who showed me some exercises and released me to work with no restrictions. I could barely walk! The benefits stopped, the Nurse Case Manager said my case was closed and that the Ins Co would not pay for more PT Rehab. My employer left town so I was not offered reemployment.
Any suggestions on what to expect??

How long will depend on when the doctor sends the report; they can't calculate the benefit until they know the impairment rating.

I have no experience with WC - what do you mean by "calculating the benefit"? What benefit? Does that mean they will reissue benefits? ..or calculate my injury rating?

Seems to me if you can't work or at least return to your job you need to speak with a lawyer. Have you talked with any to get a better idea of what can be done with your case?

so you have no idea what MMI is or what it is for or what the benefits are or how to get them?

"Permanent Partial Disability
South Dakota law provides for a set amount to be paid for impairment of certain body parts. A medical doctor must determine a percentage of impairment."


there is lots of information on your benefits and how to get them on the state work comp website.

I have spoke to an attorney but he is working only on Appeal for SSDI. I will contact him to ask if I have any options for getting back WC benefits - maybe I have to contact South Dakota Labor Board??

you will need medical evidence that you can't work in order to get either SSDI or resume workers comp temporary disability; they are not going to take your word for it.
if you want to dispute the work comp decision to stop your temporary disability, you should
"Call 605.773.3681 to discuss your problem with the Division of Labor and Management specialist."

manley is correct: with no clue about comp you should think about getting an atty that specializes in workers comp
