13 yrs of harrassment, hostile work and stress in California - daystarchis - 11-01-2012

Hello,
I been working at this big non profit company for 13 yrs. Around the 3 yr I filled a discrimination and harassment complaint to the corp office. Nothing was ever done and no reply back. Around the 5 or so year, I filed a sexual harassment complaint to my supervisors. Nothing was done or said. My supervisor even begged me and another employee to spend the night with her because she was an alcoholic and need to detox. Well, after much pleading I said ok. I been called by a co worker MFer and reported it with witnesses but NOTHING. My work load increased and more subjection's to yelling and unethical hostile work environment.
About 4-5 yrs ago It got so bad I was gonna hang my self and wife interrupted me (THANK GOD)! I went to a doctor and she referred me to a psychiatrist that immediately took me off work which ended up being 3 month on FMLA. I was on SDI. Since then, my work and stress has continued and got worse. There are a few co workers sort of in my shoes. I been there the longest at 13 yrs. I got a lot of witnesses and e mails and doctors documentation that the work stress caused me to remember a lot of tragic events in my childhood. I am on a lot of psychotropics and at this time can barely function. Going to and from work is a blur.
Oh I have perfect evaluations, awards ect for 13 yrs. QUESTION...

Do I have a case? Is this workmens comp? And can my psychiatrist take me off work and it be workmens comp? I been seeing him consistently since my first break down (4-5 yrs). Any info, attorneys, advice would be helpful. I am scared and feel alone. Oh, I live in California.

yes, as long as you have medical opinion that your work is the predominate cause of your need for treatment.
yes, temporary disability is a work comp benefit.
doctors are required by law to report work injuries to the employer and the state.
talk to your doctor as to why that was not done and find out if they will now.

Thank you 1171. I am very scared of our corporation. They are unethical. Just this last month my supervisor told me and the administrative assistant that her VP told her that an employee wrote a complaint to the president and the VP wants revenge and told my supervisor that she needs to find away to fire him. Since then, they cut his hours from 40 hrs week to 32 hrs a week. Now his doctor took him off work for 2 weeks due to job stress. He does not know what I know. These are similar situations I go through. I don't know who to trust. Should I consult with an attorney?

I'm not sure what kind of litigation you want to initiate; you have not filed a claim yet.
if your employment is covered by FMLA, you have 12 weeks of job protection.
after that you can be legally terminated.
if you want to try to find violations of labor/employment laws to file suit over, you can contact a employment lawyer.

I suspect most of the complaints will appear minor since they were not serious enough to cause the employees affected to quit.
