when attorney asks for minimal fees... - sonny1 - 05-21-2011

through comp judge (at hearing) does it deduct from the attorneys overall payment or is it in addition to their final payment? I'm in NY. My 1st Attorney who did nothing got $1000 from me (well comp checks) in 2 1/2 years of doing nothing! My new attorney has gotten about $300 (in $15 increments out of comp checks) Just curious if that goes to "expenses" separate from their payout or is it all included and then deducted from their "total" percentage?

Thanks for your help!!

Sonny I would suggest you like at the contracts you have signed with the attorneys. How they are paid the expenses will be in the contracts.

I had one attorney, he was paid a % of each TTD check, at settlement time the expenses were deducted, with my attorney taking his % from the total awarded at settlement.
