Lost in the wc system

my injury is in texas and I really need some advice.

The problem I'm facing is that there seems to be no "fix"to my lower back injury.

I've been injured for over 5 months. the first couple of months consisted of pain management, physical therapy and electro stimuli. This was due to the first MRI being negative for any damage. I had about a good two to three months of tolerable pain. The pain wasnt shooting down my leg anymore, I can sit without any pain etc. Yet, the muscle spasms were still there.

This past month the excruciating pain has returned. I can't do physical therapy, I can't sleep and so on. I request another MRI because I know my body and something else is going on. They do another mri of the sacrum area because that was missed in the first MRI. They find a minor bulge/dissicated encroaching on my left nerve.

now, the doctors aren't acting nice anymore. They have lifted my light duty restrictions so that I can go to work, my treating doctor is not treating me properly and the spine specialist I just saw today said my injury is just muscular. Even though I have the actual radiology report stating that I have an encroachment of the neural foramen on the left side oo that I have a minor bulge or that I have been doing p.t for over 5 months. His recommendations are to take ibuprofen and do more physical therapy. i cried in his office and I cried on the way home. Im 28 and im in pain everyday, nothing helps. All I want is to feel like I did before my injury. Pain free and no one seems to want to help. All I want is good medical care, quick and with good bedside manner. What should my next step be? I have a feeling they are trying to close this case quick. Does this happen often?

Honestly yes. WC is not trying to get you pain free or even back to your pre injury staus. They want to get you mmi at some level and that is all they will do.

I would probably try my own Doctor before I closed with WC to see if my Personal physician agrees or disagrees with the WC Doctors.

Most who have a back injury never live pain free again. UNLESS it is 100% your last choice, Leave harsh narcotics alone. They have major side effects and at 28, It would be my last resort knowing what I know now.

Good Luck and believe in yourself. Mind control is 1st line of becoming able to deal with pain.

Seeing my personal physician is a great idea. I will make sure to see them today. If they disagree should I than get a lawyer? also, whats mmi? :/

I pretty much have no support system, father dead, mother in her own world and 8 hours away. My husband is now the only bread winner so I can't bother him to help me with all this. We have two growing boys, so to even get to a state where this is constable this would be great. This is one crazy system!

MMI is Maximum Medical Improvement. This is when the WC systems decides you are as good as you will get per there decision and Doctors.

It could be hard getting a Attorney at this point. I would definitely get a 2nd opinion from a Doctor (Orthopedic or Neurosurgeon). It could be costly but this is what I would do in your situation.

ask for a disc o gram it is a "no fail" test of the disk area that a mri and xray misses if your pain is still that hi and you are not a baby when it comes to pain ask for this test but ask for it to be done at a pain clinic. it will show if the discs are leaking and causing the pain you are feeling. Be advised this is a painfull test if they are leaking so have it done at a pain clinic .they also told me nothing was wrong after this test they found the leaking discs.

........I love cats, I just cant eat a whole one by myself......

if your treatment is provided by the employer's medical network you can request a change of doctors or a second opinion by putting your request in writing to the comp carrier.

My opinion is based on where you seem to be with your WC Case; At the end.
By all means, Look for a WC Attorney.

the end is where the $$$ are.
you shouldn't have any problems finding a work comp specialist.
litigation will likely delay the process significantly.

I would say it's never too late to get a lawyer. Get one ASAP. Chances are he/she will even have doctors on call they will send you to. I don't know the laws where you are but in my state I can see any doctor of my choice after 90 days under workers comp. Just know the doctors you are seeing now work in conjunction with the comp/insurance carriers. They don't care about how you feel.
