			<description><![CDATA[Hello everyone.  I am new to this forum and am hopeful someone will be able to offer up some insight as to what I can expect in the coming days and weeks.<br />

First some background:  I am 45 year old male from the wacky state of California.  Up until 03/02/008, I was a police officer.  I sustained a severe injury to my left leg during a struggle with a suspect who was wanted on a felony warrant for drug sales and possession.  After nearly 18 months and five extremely painful medical procedures, I was diagnosed with CRPD and had a spinal cord stimulator implanted on 05/05/09.  Thus far, the implant has worked as advertised...I achieve about 55% pain reduction...the other 45% is managed through medication.<br />
<br />
Just this past Tuesday (06/30/09) my primary doctor rated me at 41%.  Three other doctors (including the one the IC forced me to see) agreed with this finding.<br />
<br />
Since my scs trial procedure totaled &#36;21K and my scs implant came in at &#36;92K, can anyone tell me if they think 1) Will the IC contest the findings thereby forcing a possible trial? and 2) What do you think my case may be worth in terms of a settlement?[/size][/font]]]></description>

My manager stated in a meeting the other day that should anything happen to any of us she will be going to the Doctor's appointment with us. I stated that she would not be going into the exam room with me if that ever happened and she got pissy and said she would. I told her that would be a HIPPA violation. She stated that it is not against HIPPA. basically just making that statement got me on the S list fast.<br />

			<description><![CDATA[I hurt my shoulder at work and was on comp (totally out of work) for about 8 weeks. Strained my shoulder and found out i have bone spur and arthritis there,(dr said it was due to repeditive motion)I went back on sedentary duty and am waiting on approval for surgery.Anyway,i have had problems with my hands and was diagnosed with carpal tunnel syndrom.I have in the past 6 mos had problems with my knee and hand due to ortho arthritis. my question is how do i file for occupational disease so i am covered for the future if i have to be out of work .I am not out of work for my hands nor have i claimed workers comp for them.I did hurt my right hand and my knee years ago at work ,have a report on it but never claimed comp for it.I have been in food service for 16 years and  O.A  and C.T.S are listed as a disease for my occupation.<br />

			<description><![CDATA[Hi Everyone I am new to the site and have a question for California.  Is it legal for the surveillance team to use a helicopter to take pictures of the IW.  That is exactly what they are doing to me.  Atleast 4 times I know of and who knows who many times they went and I was unaware or not present.   I already saw them in there Van and knew they could do that but a helicopter isnt that going too far.  What a waste of money shows where there priorities are,not paying me all this time I have been out of work but hire a hellicopter to get the pics they need. All I am doing is taking my Dog to the Park and in court they will try to make it look like I am faking it.  When I have no other choice because of where I live a 1 bdr Studio Apt with no yard for my dog to do his business.  The Park is  blocks away so I take him there alot of trees and trails.       I would like for someone to read this to see if I have a claim on SSDI. I retired in May from Military active duty with 28 years of service to this Great Nation. I was an Infantry soldier for 14 year a Calvery Scout for 6 years and for my last 8 years I was a Combat Engineer. I have applied for SSDI and VA for compensation with the following conditions:<br />
1. Sleep Apnea with CPAP<br />
2. Ulnar never entrapment, Left Arm at elbow level (Dominate Arm) (Surgery has put limitations on arm)<br />
3. Bilateral Sinus Musosa and Polyps due to allergies. I recieved surgery to clean out Polyps. <br />
4. Knees R & L, MRI shows chondromalacia of the patella and degenerative joint disease. Chronic pain.<br />
5. Ankles R & L X-ray shows Authritis, DJD.<br />
6. Lower Lumbar Spine (MRI) degenerative joint disease and facet arthropathy. mild disc buldes. Mild L5/S1 neuroforaminal stenosis. Chronic Back pain secoundary to scoliosis.<br />
7. Cevical Spine (MRI) Degenerative Disc Disease or possible herniative disk at this level. Aurthritic spurring of C5 and C6. Associated encroachment upon C5 and C6.<br />
8. Hearing and constant ringing in ears (percribed hearing aids)<br />

9. Exsposed to radiation<br />
<br />
10. Exposed to Agent Orange<br />
<br />
11. Exposed to Asbestos<br />

A little over a year ago I fell off a ladder at work and injured my R shoulder. I had a torn rotor cuff, and had surgery to repair. Well I just had to have another MRI done on my shoulder because it started to hurt and popping again. The doctor told me he did not think it was a big enough tare to go back to surgery. That we should try some injections first and see how it is in 8 weeks. After telling me all of this, he looked at me, and said on your next visit I will give you, and the insurance company a number for your arm...how much loss of ROM I have lost in my arm is what I think he ment. I am not sure what he is talking about, I was hoping someone could help me out here.<br />

What does this number mean?<br />

I don't have a lawyer as of yet, and was not going to get one.<br />
<br />
Do I need a lawyer at this point ?<br />
<br />

Hi everyone....I have an issue that I need to discuss with someone that knows all about WC.  Prior to my injury on June 20, 2009 I had been working three days one week and then 4 days the next week.  Now the new schedule has been put out and I am only working 2 days one week and 2 days the next.  So basically I had 3 days of work taken away from me.  I am pretty sure the reason behind it is because of the claim to WC.  Is it legal for them to cut my hours just because I got injured on the job? I know that they are slowly trying to weed me out of the workplace, but don't they have to tell me why they cut my hours before they do something that drastic?<br />

Any and all help or advice is very much appreciated.<br />

I am a Male 44yrs from Oklahoma...I'm Married (18yrs) and have a 7 yr old son who is my world.<br />

In Dec. 07 I was in a no fault MVA I had to have knee surgery right away! and I did ...It went fair!...then I had surgery on my lumbar (2 level 360) after exhausting all other options first...I'm still healing and think it was a good move.....now the question I have is....My 3rd injury was to my Thoracic area....T8-9 bulges ...very painful and debilitating....the problem is doctors dont like to do surgery in this area....it's risky if you can even find a competent doctor who does this....It involves alot....I think I will live with this injury without doing the surgery.....How will they rate my injury without me trying to improve it? <br />

I'm in chronic pain but I can deal with it without pain meds for the most part....I was never big on meds anyway.....I'm worried they will make light of my injury that is the most painful of the three I've had.]]></description>

I think I should have Used Better Wording, I wasn't Implying anything about the Entire "Site", I meant to Say that the Regulars on the "Off Topic" Section haven't been on Much Lately. I was Hoping to get Others to Check in, which Many Did, but then We got Off Topic, and again My Fault, and the Thread was Locked, so it didn't End up at the Top of the Page and give Prospective New Members or Advertisers the Wrong Impression. So to Make things Clear, there is Absolutely Nothing Wrong with this Great Site, or the Great People who Use it!! I have been Dealing with Quite a Few Serious Problems other than My Pain and Injury, and My Pain Levels are through the Roof, and I Fear I may not be Posting Clearly, or when I do it may be a Bit Depressing and not doing what it should be Doing, Helping. So I think I am going to get Myself Together, Pull Up My Boot Straps, and not Post for a while until I Feel I can be of Assistance, Rather than a Downer! fell on 4/26, Sun, left work after write up & ice.  Went to OH Dr on Mon, rest of day off, next 2 days off were sched off, stiff & sore, work as a floor walker, 2 wks later; PT made things very painful, for 2 more weeks, req Xrays, thorasic & lumbar stains, hip pain.... req Chiro, go 2 x week since.... today was too sore & painful to get OUT of the bed, is a holiday weekend... no dr's office open!!  Must i go to Hospital for note (& should it include Fri, & Sat - if needed?) got back "in" at about 3pm, boss says "may or not be excused" with or with out note..  Could also get note on Mon's Chiro visit    Help!!!   which should i do?? Hosp or Mon,   am in pain,,,,,<br />

			<description><![CDATA[The July 4th holiday has always been one of my favorites.<br />

My father worked as a machinist for one of the large aircraft plants in Wichita and the first two week of July the plant shut down.<br />
<br />
My family ran a fireworks stand during this time. The cracker box as the stand was known was well known by the community, my father continued running this stand for 20 years.<br />
<br />
I wanted to start this thread and share what my family will be doing over the 4th and hope others on the forum will also share what their families will be doing.<br />

Friday will be our family celebration; members of the family will get together at our country home for supper.<br />

Our neighbor on the hill always has a large firework show with professionals that come in sets up, and shoot off the fireworks. We are able to view the show from the deck off our home.<br />
<br />
Saturday I am going to the horse races in a near by town. I love going to the races but this will be my last time at this track as it is closing down. There is a chance the track will reopen in future years, if we get slots at tracks.]]></description>

I live like 45 minutes away from the doctor and OT that I have to go to regularly, not sure of the miles I travel but can I get reimbursed for those miles traveled to get there?  LIke this week I was at OT will be 3 different times, and last week was there 4 different times.<br />

What do I need to do to get reimbursed for those miles? Gas is expensive right now.<br />

also, how long does it usually take to get a check for all the meds I have been paying out of pocket?  <br />

I am just really confused about this whole deal, and my employer just acts all pissed off that I even made out a claim so I can't really talk to her about it.  Any advice or suggestions will be greatly appreciated.  <br />

I would receive a check for 3 or 4 weeks and then they would stop, only to find my name has been kicked out of the computer, or any of the other 10 or so reasons given to my attorney.<br />

To complicate things I also receive SSD, and given the problems I've had with the insurance company my attorney told me, You make arrangements to pay social security administration back and my secretary will help you if you need documentation fro us"<br />

The worker from the local SSA office that has helped me from the start start is a great guy, even called me at home to let me know I had been approved for SSD when I first applied.<br />

It has taken a while to get things arranged with SSA so I could start paying them back with the correct amount I owed them.<br />

Seem like everything happened last week, I reached MMI last week, and I received the letter from the processing center with the amount I owed to SSA.<br />

new to this whole workers comp stuff. I got hurt at work, I work as a CNA in Iowa at a nursing home. Tripped over a table, didn't fall but screwed up my neck and shoulders enough to make me be in pain constantly and it happened almost two weeks ago with no relief as of yet. <br />
My doctor, that I had to go to for W/C thinks that I can go back to work with 10 pound weight restriction only. The occupational therapists that I am seeing three times a week think that I should not be in an environment that would or could potentially make the injury worse. Also the chiropractor that I did see twice says he will not touch me till I have a MRI,he also agrees that I should not step a foot into work till I am more healed. I am scheudled for a MRI on Tuesday of next week.<br />
My question is basically can I take FMLA during this period and still get all the W/C benefits, like it paying for my MRI and meds? Also, I seen our W/C doctor when he was in the office, now he is on vacation and seen someone else that is taking his place while he is off work. Is the doctor that I seen today then the second opinion that I am entitled to?<br />
This is all very confusing to me, and I am wondering if anyone else has had this problem or any suggestions for me. My administrator is hell bent on having me be there. Is that so my injury looks to the insurance company that it is not as bad as I make it out to be? <br />
