For 2 weeks my pt has been saying he has to give me a FCE and has never done it. So today was the big day, seen my Rehabilitation Physician so I can go back to work. And told me there was no reason to do one cause they know the work I do and says I am ready. This was in front of that lovely ncm, and she starts saying he has no restrictions, I put up a stink and got one set up for next week. Called my lawyer and he said I made the right decision and need to call him when I get done with test.

My question is= is that normal or even legal to send a person back without being evaluated. I want to go back to work but I also need to protect myself. What are they tring to pull, any advice or suggestions.

I have a few questions since I just got put out of work by my doctor. I hurt my back at work a few months ago but singed a deny medical treatment paper. A few days later my Back still hurt and while lifting a mattress my back went into a spasm. I went ahead and saw my own doctor for this. After that I was at work and pulling some steel and my back went completly out. I was on light duty for a while and now I was placed out of work. My question is will I have a problem with disability since I didn't see my works doctor the first time I got hurt then saw my doctor first?

Nearly one year ago I was hurt on the job. As of today, when the doctor's office called, AGAIN, there has been no work comp payment made.
I have been going to see my boss every few weeks either with statements from the doctor or just to ask him if he's heard anything from the insurance yet. I always get the same answer: Let me call them and I'll get back to you....he never does....it's been going on like this since December '07. I'm afraid this medical bill will go into collections and go against my credit, so I'm ready to start making payments on it myself.
When I told the doctor's office that I would pay it, they said that was fine, but if they received payment from workman's comp, they would put that as a credit on my account and NOT send it to me as reimbursement.
I feel as though I'm really stuck here. I'm only asking for the medical bill to be paid, not for any time off work or residual pain, but I'm almost tempted to get an attorney to get out from under this.
Do I have any other recourse besides continuing to talk to my boss, take in the statements and wait it out for who knows how long?
I'm an "at will" employee and I really need this job, so I'm very hesitant about raising too big of a stink about this. Any words of wisdom from anybody will be greatly appreciated.

I got a call from my oldest daughter yesterday that she returned to work after being out for 3 months for a pineal cyst plastic surgery. When she was 18 ( now 28 ) she had surgery to remove her large intestine due to Chrones. She had a colostomy bag for 2 yrs. and during that time she had a pineal Cyst which the doctors would not do surgery on till 2 yrs. later when they were to reverse the colostomy and hook her back up to her rectum. She now has a J pouch.

During that time her cyst got so deep that she has had 8 surgeries now to try to close it up and has had many doctors try different things to do it. It is now opening again and the doctors are at a loss of what to do now. She also has fibro and is going to a pain clinic and having PT/OT every other day.Her job is cleaning corporate Jets. She has alot of bending, stooping, getting on her knees etc. to clean them inside.

Yesterday her supervisor asked her how she is doing. She has been back to work for 2 weeks now and she said she is doing good except her back hurts alittle. Her HR dept. insisted that she go to their doctor to be examined right at that time. Their doctor looked at her cyst and asked her many questions about her medical history and then gave her a note for light duty work. As soon as she got back to work she was called to the HR dept. and told they do not have light duty work and to go home. They would call her back on Dec. 20th.

My question is. She went back to work and was not complaining and was forced to go to her works doctor to be examined. Then let go for a few weeks because of no light duty. The HR dept. was going to call her back last night and I have no idea why she was going to call, but my question is, she needs insurance because of her health problems and now what happens? She lives in NH and is she now considered on WC? Do they have to pay her now because they had no light duty and sent her home? She does not know what the WC insurance co. name is, or what to do.

I know she is a big risk to the company with all her medical problems, but she has looked around for jobs to do and cannot seem to get hired right now. She really knew that this job would be hard to do with bending but still went back to work and was doing it without complaining. What sort of steps should she do now? Will she be paid to be out of work? I have always felt that she should be on SS because of all her health problems. Should she apply for SS? I know if the doctor writes that she has all these medical problems that she could possibly receive SS. I know she is still young , but she has been through a rough life. Any help, suggestions on where to go right now or what to do would be helpful. She cannot afford an attorney. I did tell her she needs to call a WC lawyer and get a free consult on what she needs to do and what her rights are.

I know this site has very good information and I was just wondering what her first step to do would be? She is very upset now that she has no income and could lose her insurance.

Hi guys, my earlier post explained my problem with getting my mileage check mailed to me. It has now been close to 3 months since the original request was emailed to the i/c's case worker and I've yet to see or hear anything.

My question is this, where can I find out if there is any time limit, in the state of VA, that they need to get the check sent out. I have read other posts that said their state had such a thing and I'd like to know if my state has something similar.

BTW, I have asked my lawyer's secretary and she said she did not know of any law that said that they had a time table on checks, but she would give the message to my lawyer and she'd get back to me. However, she is on vacation for the next week, so this is why I am hoping that someone here will know the answer.

Thanks guys-

Hello All!

I was injured on the job at the age of 20, am 22 now. I injured my lower back. I had MRI/X-RAYS taken which didn't show any evidence of a slipped/herniated disc, which lead to a diagnosis of "mechanical back pain", I was also told I would have pain forever on and off because of significant scar tissue buildup, so assuming the damage was muscular.

Anyway, I got a lawyer just in case, so the workers compensation company didn't try to pull anything over on me. They paid me on time, correctly, etc. Very friendly agent from this company personally assigned to me, but I bet she would screw me if she had too, so I watch my back even more (haw haw). I returned to work for awhile after I was rehabilitated (had a few shots in my lower back, PT, etc), then left again because of my back.

Didn't work for awhile, on, off, on, off. etc

I told the lawyer that I wanted to have a settlement from my case, and he asked me how much I wanted, I had no clue, so he said "How about we ask for $100,000) I said "wow sure fine". He wrote two "demand letters" which he hasn't received a reply back for, he says "they aren't legally obligated to fulfill the demand because it hasn't been two years after the date of accident to file a suit for "wage expectancy", this January will be two years.

What I'm asking is:

What is wage expectancy? What will I get from that?
I was making like $8.30 an hour

Can I settle? If I worked it right, how much would/should I receive?

I ask here because im too young and don't have parents to explain this to me. Secondly, since im not 100% disabled, and my condition is stable but not 100%, I feel like it would be a better option for my future to use the settlement money to wipe out my college tuition.

Help,please?

I just got a letter from workmans comp saying that, in their opinion, the MRI that I had on several occasions did not show a herniated disk, but a Tarlov Cycst, which mimicked the appearance of a herniated disc. And to top that, they are also saying that the original surgery that I had was nothing more than an extensive exploratory surgery! They are now bypassing my surgeon and asking for another opinion from a surgeon of their choice. In the meantime, I am finding it more and more difficult to walk, sleep, sit, move, etc. I am not sure, but if their surgeon says that, yep, it was a mimic.........then I have to pay for the origional surgery? Or pay back all of the temp payments? They have set me up an appointment for December, which I have been told I have no option but to attend.

Has anyone ever had this happen before? How can all of my symptons be blamed on a cyst that I had for years, and only caused pain when I had the workplace accident?

I will try to answer how The Daver is doing, but since they have no DX it will be difficult. He has anemia his H&H is very low. On the other hand his ferritin, which has to do with his Iron levels is extremely high. He has had bone marrow aspiration, which he said they will never do again unless they knock him out. They can't find leukemia, which is good, but they don't know what is causing the abnormalities in his blood. Now the Dr. wants him to start injections of Aransef, not sure of the spelling, most of you will have heard of Procrit, which is the old version of this drug. The problem here is the injections are $1,200.00 each and they want him to have them at least every 2 weeks. If that doesn't work he will have to have them every week. The insurance co. will not pay for them. Also the injections have an extremely high rate of causing stroke, heart attack and blood clots. So with the price of them and the side effects it has scared him to death and he refuses to have them. The really strange thing is he has absolutely no signs or symptoms. Nothing....no bleeding , no fatigue, no confusion, absolutely nothing.......I know you can raise the H&H by eating foods rich in iron, but then we take the chance of iron overload. At this point we are just going to wait and see what happens, this is what he wants. If I see any signs that he is in trouble I am going to take him to the ER and they will have to give him the med or a transfusion. He had a CAT scan done today chest and abdomen and hopefully this shows what the underlying problem is. Another thing is since his platelets aren't maturing and his body can't get rid of the excess iron his spleen is greatly enlarged, which of course he has to watch carefully. Everytime we think we have this thing figured out something eles is thrown into the mix. If I could only go back to work and not be hurt, it would help so much. This time of year I could pick up so much overtime that we may be able to afford the shots, but they would only bring his H&H up and wouldn't tell us what the problem is. I keep telling him I could try to find something I could do, but between you guys and me I know I couldn't do it and it would make me totally useless. We are just going to take one day at a time and pray that everything works out. Please pray for him he really needs it right now. He is keeping a good attitude about it, I think this is more for me than that he actually isn't worried, but we will work this out somehow.

Hi all,
Today I finally got my computer hooked up and online, I had to get a new internet provider due to my old one not having any dial up numbers at my area. I have a lot of catching up on reading the posts.

I would like to thank everyone who have been following my cross country drive, and praying for me and giving me good wishes. They worked, I arrived here safe last week and then went down to get all of my things out of storage this past weekend. My son-in-law and his friend went with me. My son-in-law drove my van the entire way down, which was 6 hours one way, so that I did'nt have to. Everything was loaded into the Uhaul truck on Sat. and we stayed at a hotel and drove back on Sunday. Sunday night it was all in my apartment. I'm still trying to get unpacked, lol.

I would also like to thank Red & Del for thier hospitality and allowing me to stay at thier home the first night. Red taught me how to paint on Christmas balls and also gave me a few things for my daughter and had the item that I asked her to make done for me. It was a great visit.

Limbo and his wife were great and left me spend time at thier home as well. I originally was only going to spend 1 night, but due to the weather, I stayed 2. The beef stew and biscuits that Ellen made were great. That was the last time while on the trip that I was able to get online, until I reached my daughter's home.

I was very happy to meet Undercover Angel in Oklahoma, it was as if we had met before and talked like old friends. We had a nice lunch and played some at the casino. I don't drive (if I can help it) at night because of my eye problems, so I had to go and find my hotel, and we parted ways. I would have liked to have more time with her, but was happy for the time we did get.

Tuffy kept in touch most of the trip, until she disappeared and went to her brother's on the spur of the moment. Then I was worried because I could'nt reach her by phone, and could'nt get access to the internet. I ended up calling UA to find out when she was on here last. Tuffy did call me after she returned, but I was in the middle of getting the things from storage. Thank you Tuffy and anyone else for keeping the forum family updated on my travel.

I tried to contact differant people by phone while I was gone, I'm glad to have such a great group of people to be able to talk to and for those who gave me traveling advise.

Sorry that I ended up writing a book, lol. I have missed y'all so much. I will try to get on more often now that I have my computer working. For all of you that were on my Christmas card list last year or if you want to be added to it, please PM me if your address changed. If anyone would like my new address, Please PM me and I will give it to you. I have learned that I can trust my forum family with my info. My cell phone number is remaining the same for now, but I do have a new home number.

If I left anyone out on the thank yous, please overlook that and know that I thank y'all for watching over me so well. I really enjoyed knowing that on my trip.

Love

As some of you know I have been working a little here and there for a friend. It involves lots of driving so I work a day and then take 3 or 4 off to recuperate.

My license renewal was due earlier this month so like a good girl I renew online and pay my fees.

Today I receive a letter stating my license is suspended/revoked in Arizona from a ticket I evidently received in Sept. of 2004. I have a file just for tickets and have no info whatsoever on this ticket.

The court clerk I spoke to said this has been in collections since Dec. of 1994 yet it wasn't on my TRW when I paid everything off 2 or 3 years ago. I have no way of fighting this to prove whether it was paid or not as I don't have financial records dating back that far. They said the ticket is 549.50 plus any fees due the collection agency.

I have 3 weeks to either pay this amount in full (which I have no way of doing) or lose my California license.

I swear I can't win for losing. Just when I find something I can do and have a really nice boss who lets me work when my pain allows, this pops up. I am so frustrated, grrrrr

Thanks for letting me vent.
hugs,
