I have been out of work due to a work related injury for over a year have had to have back surgery now i want to return my previous postion is no longer avaliable i have restrictions on what i can do they have been giving me the run around for six weeks not saying if i can or cannot return what should i do

I INJURED MY BACK IN 2002. workmens comp kept denying treatment I HAD 6 INJECTIONS ON LEFT SIDE AND 4 ON BOTH SIDES. They tried making me switch Drs. when he wanted to do decompression surgery so we went to court Judge ruled in my favor.Workmens comp replied by saying we don't give a damn what the judge said we will not authorize surgery we don't know what are lawyer is going to do. After a couple phone calls and a couple of weeks they called my Dr. and asked why we did not schedule surgery yet. I had decompression surgery on L4 L5 and L5 S1.When leaving the hospital they called for authorization for a walker a cane and toilet seat riser saying I would need these at home workmens comp told yes these items are not expensive and he will need them.My first day home I got a phone call telling me that they would not approve these items that I would have to send a check for my walker and if I wanted a cane and toilet seat riser I would have to pay for them myself. A month later I recieved a toliet seat riser. When it ceme time for physical thearpy it was denied more phone calls then they approved 4 weeks 2 times a week 4 more weeks was recommend which is normal for this surgery and this was denied a month later they approved more thearpy. All these denials of treatment delayed my recovery. Now workmens comp is telling me that I have to switch to a different Dr. and my condition was deemed Permanent& and Stationary my Dr. says that I nead to have a double fusion. There attorneys asked if I would be willing to go back to work under my Drs. guide lines I Explained my concerns that I
could be scheduled as many as 10 days straight that I could be scheduled to midnight one day and be back at 8 in the morning the next day.We came to a agreement that I would return part time with my Drs. approval. Now the company I work for will give me a answer. |

looks like you may have to find another employer. depending on your state there may be additional benefits e.g. job retraining or vocational rehabilitation.
without knowing your state I can't be specific. |

If you been out of work this long, that don't need to take you back. They can though re-hire you if they wish.
