Who decides?
I am in California.
My neck was injured 12/08. I do have an attorney. When I was injured, I lost the feeling in my hand, lost range of motion in my neck and arm. I would also mention the intense pain, but, in the end, WC does not concider what pain a person is in when they are doing their thing. Anyway, since the injury, WC has had me do the following: 50+ bottles of medication, PT, epidural injection, corazone shots and finally surgery (3 levels in my neck fused). I have had 3 doctors tell me this was the final solution, nothing more could be done if the surgery did not help. After 15 months and following everything WC has had me do, all the issues I had when I got hurt still remain. When I see my doctor, I am told that all we can do is wait it out and see what will happen: continue PT and meds. I have read many posts of the years one's have endured and 15 months may make me seem impatient. If my symptoms have not improved since day one, who has the final authority to decide that nothing more can be done so I can go on from all this mess? My attorney said they have to wait to get the paperwork stating this, that they cannot force the issue. Left up to the doctor, I will see them forever as they are afriad they will lose me. |

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

hello there, I understand your pain, I was also injured in june 2008
and like you, I had injections, pt, and lots and lots of pills finally in sept 2009 doctor recomended surgery(3 level laminectomy. L3-L4-L5 and my pain is still there, and Iam also waiting to see whats gonna happen with me at the end of all this, I have been told that my Doctor has the final saying he has told me that he is going to try to put me in permanent disability. but the way it was explained to me, my doctor will recomend premanent disability. but it can be disputed by wc in court, so good luck, and Iam still waiting it out! |

It's hard for us to come to terms with the fact we just might never get better. I hope you can find some more help and get better but there is a point when nothing more will help. Keep fighting for the right care to make life better because there is no wrong amount of time to think it is too early to worry about. I pray you will find the help you need to live pain free
