re-occurance
i live in ny, i was out on wc from may of 09 to nov 11 09, i have noticed my injury is flaring up for the past week, can i claim this as recurrence of my injury, what do i do. is my case still open, i had no settlement should i contact wc board

generally to have a work injury you need a cause that's related to your work. it's not enough to have similar pain or pain in the same place. you'll need medical opinion to support whether this is part of your prior work injury or something else. discuss the probable causes with your doctor before deciding how to proceed.

well thank you
I will be seeing a doctor for follow up anyway, but this was a cause and effect situation. I lift at work after the effect is pain. it was controllable , but it is a copy of what got me on wc last time. Should i mention this at work now or wait till i see doctor thank you |

I had the same thing happen to me, I notified my employer and told them I was going to see my Dr. I could not work, and was placed on STD and LOA, and FMLA and then when they did not file a WC claim for me I contacted a Attorney and he filed the claim on my behalf.

If it is repetition from your first injury, Do notify your employer as there is usually a statue of limitations for reopening an old claim, and most companys have a time period on which to report an injury etc to them.
Depending on your state, it could be considered a new claim,,,,, Mine was here in Illinois.... Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |
