Suffering psych client
I'm an attorney for applicant who demanded medical treatment pursuant to LC 5402©. However defendant has refused to provide treatment. Its been less than 90 days since the DWC1 filing and they haven't accepted or denied. I filed a DOR on 1/21/10 and our status conference is not till 3/24/10. How should I have handled this issue?

If you cannot get a fast response here you may want to try the
Employers and Professionals Forum. Some people give help in both areas so you should be able to 'speak' to someone soon enough. Just be sure in include the state you are from. Good Luck. sounds like you are located in california.
if so, you might have access to treatment providers who will do so under lien or have them use their regular health insurance. you could also file for an expedited hearing. you should consider adding 5814 penalty request and filing a complaint with the Audit Unit http://www.dir.ca.gov/dwc/audit.html make sure your client files for SDI asap |

(client could be MMI by time she gets an appt). Client is getting SDI. Penalties seem inadequate. The rule is short and clear and yet . . . . |
