demoted during workers comp
my doctor has not released me to full duty yet, and my manager is telling me that he wants to move me to a different position and decrease my pay...is this legal? I am not happy and feel like they hould not be allowed to do this.

RE: demoted during workers comp
If you are on work restrictions, and allowed to work under such restrictions, your employer is allowed to modify your work and pay scale. This is all very legal. Now the Insurance Carrier that pays your TTD while off work, will also modify your TTD to comensate for the lost wages, but not more the 66 2/3 that you would have normal gotten. meaning your pay from emplyer and the IC should match 66 2/3 of what you were making at the time of injury.

Yes, it is legal....

if it is retaliation for filing a claim you may have basis for a discrimination complaint.
