Hi, my sister was at work at a major department store when she slipped on some standing water and fell and broke her foot in 3 places. Can I assume this is something that will fall under WC? Will the department store be responsbile for the hospital bill? Can she collect any wages while she is unable to work? Does it matter that she wasn't full time?

This does look like a work related injury.

Work comp is state specific, we will need the state your sister is from so we can provde you with information

Sorry, it is Indiana. She is having surgery due to the injury, according to the hospital the foot is broke in 3 places. See was on the sales floor and hit a puddle of water, which I am guessing was from snow covered shoes of customers since we have some significant snow on the ground. She has been working at this department store since mid November and has been getting between 25-40 hours a week, but not always a full 40 if that matters. I figured the store would be responsible for the health bills, but will she be unable to work for at least 2-3 months so will she be able to collect any kind of pay compensation?

Yes it is work related and a work comp covered claim. Yes, she needs to file a cvlaim with the State work comp board. Yes, she will get paid 66 and 2/3rd her average pay that she has made for the year, or for as long as she worked there going back 12 months. She needs to contact the employer, ask what is the name of the work comp insurance carrier, policy number, phone number, and person of who to contact.

She has been working there I believe since mid november, but also during this time has been collecting unemployment benefits when she didn't get that many hours. How or does this effect her unemployment? So after she gets the info, contacts that person, what questions should she ask, what does she have to fill out?

I read that you can collect both WC and Unemployment, so I guess it would be smarter for her to collect the WC for as long as she can even though it won't be as much as she was making with her PT job and Unemployment and then once the WC runs out go back to unemployment.

Am I right in that she can only collect WC for the amount of time she was at the job she was hurt at? So in her case she was at this job for about 15-16 weeks, so that is how long she can collect for?

Also, will it be WC that pay all the hospital bills?

temporary disability is paid as long as she is disabled up to 500 weeks; no time limit on other benefits.
hosptialization is included in medical benefits.

Really, I guess having a broken foot in 3 places would count as temporary disability. So as long as she is under that she will get 75% of what she was making from her employer?

Since this happen today, and she will come home tomorrow, how can I help her get the paper work rolling? Should she contact her employer on monday? How long till she can expect to see the disability payments? Can she collect unemployement till that starts?
