I have never scared easily and will not here. I tend to rely on myself, God and my husband. We always talk things thru, pray and talk some more. Only then do we decide. Our decision very early on was not to settle. It is so sad, that even with medicare that you could be left just hanging, No able to go forward, no treatment, anything. That is where I am right now. Barely able to walk, pain that makes me cry out, little sleep, etc. No one that helps, is willing to reach out. There needs to be a stabilizing bar here, something. I don't have a terminal illness here, just a bad joint.

I just want answers and a solution.

Well, I'm sure Medicare will pick up the treatment. As to how or when I don't know. As to what they will pay for I don't know.

Would think, you want to research that part.

Now my comments are only made to the way things get posted. My comments really mean nothing. My comments are made though, to make people think, as to when these things are said to them by an Attorney, and if they didn't get the meaning of what the attorney was saying by asking why they said this or that.

If an attorney had said this to me, I would think they said it to many clients. I'm just wondering, how many got scared, needed money, and did just settle. This is all I'm bringing to light here. No need to defend the attorney, as I said only my comments. As I wasn't there.

Every time an offer is made though, the persons attorney must present the offer to their client. It is the client that has to make the judgement call. This is Law. Myself, I want the attorney to give me better advice then simply say if you don't settle it will complicate your case. That to me isn't good sound advice then. It's more of a scare tactic. One the IC attorney would use, and shouldn't be used by ones attorney.

My attorney always tells me when an offer is made he will say, it is my job to present this offer to you.

He has also asked how bad do I need the money? Course I tell him go for the medical treatment.

My friend the injured nurse had no income after she reached MMI she asked this attorney to settle as quickly as possible. The attorney went with her request and settled, although it was a smaller amount then it could have been.

But, did they Attorney advise the client of altenerative measures when their client does need money? Which then would have seemed much better advise to mention first when a client does say they need money.

We answered questions about loans or leins on a future settlement.

He also assisted her with applying for SSI & SSD.

It was my friend's decision to settle.

I believe the fact that she was moving out of state played a part in wanting to settle. She did request open medical and was awarded that in the settlement.

I for one wont settle unless open medical, although money tends to help, but can be spent faster with medical bills.. I have private ins but relly is pizz poor amounts covered, and with all info and prestent costs to wc (1.4 million just with hospital) and not including 1 1/2 years of pt and other treatment still going, there is no $$$$$ dollar amount they could throw at me for a settlement.... I will need a complete hip replacement in the future and the way my pelvis and soket was destroyed they are not looking forward to it.... So some can settle but not options for me....
