Michigan 2nd job elimination, do I have to file for unemployment?

I was injured one year ago and then had surgery in May. I developed complications and have been working both jobs with limitations on a transitional work program. I have been able to do my second job since Sept but now my position has been eliminated because they are financially going under. My work comp company sent me a letter telling me I had to apply for unemployment and they are going to reduce my payment amount until it is denied or adjust it if it is accepted. My attorney is on vacation for 2 more weeks so has anyone else had to do this? I think I might wait until she returns but wonder if there is a time limit for applying for unemployment??

Why don't you call the unemployment office and discuss the situation with them. Especially since your attorney is away. At least you will get some sort of answer that might ease your mind during the wait.

You've been given the correct information. And things have changed with unemployment, as one that had a full time job, if cut to part time, can now collect also. But yes, they will adjust you checks to meet the standard pay you should get. Their not pulling your leg here.

I'm not sure how the unemployment thing is going to work so you are going to need to talk to your attorney. Does he have any partners or legal assistants that you could talk too?

Michigan is a little different than most states. If for any reason you lose your job (yes any reason- fired or laid off- some complexities if you quit.) and are on any type of restrictions, then your WC payments start again automatically. Google "Michigan 100 week Workers COmpensation rule". My employer fired me at 96 weeks, Their lawyer miscalculated so my wc benefits restarted.
