RE: collect in prison
The only reason I can come up with why they would stop your payments is they could say you aren't working not because you are injured but because you are in prison......When I had my cataract surgery my attorney mentioned this to me. That he didn't want the IC to think I wasn't working because I needed eye surgery.....I would only have been out of work for a day with each eye anyway. Please let us know what you find out. Very interesting. Good luck.

RE: collect in prison
I know in Pa. if You are Incarcerated, You cannot Collect w/c Payments. Once Released, You can Petition to have Them Reinstated!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

RE: collect in prison
I believe that while in prision, that each prisoner has an account for personal needs that is controled by the prison. and only allowed a certain amount in that account. Where else would WC send the check???

RE: collect in prison
And I think if in Prision, the checks stop, work comp put on hold, for how is it going to show proper treatment for their injury?

RE: collect in prison
I thought I was on target with that one.....my big thing is the IC would say you aren't working because you are incarcerated.

You can have all the money on your account as you can get, in california - just for the record.

RE: collect in prison
I use to work for the state prison system with my job being in charge of inmate accounts.

My positon was of a work release facility.

An account on paper was kept for each working inmate, their earning, were recorded, an amount would be deducted for the daily cost of housing the prisioner, meals, medical expenses, and work expenses.

Inmates would receive a small percentage of their pay after expenses were deducted.
This money was used for work related espenses, examples would be luch money, or required clothing for work.

Many times after the cost of housing an inmate was deducted from the inmate earnings there would be no money left over for the inmate.

I have never processed a work comp check for an inmate, but if allowed the check would be recorded as inmate earnings.
