wow Sparkey,

I have no clue you know they make up the rules as they go along. Until the laws changed you where just out there now they say they have to offer you work so they do reluctantly. Have you contacted your employer yet or your attorney? Maybe you can get the ball rolling by making the first step. I am not sure our co. once the doctor releases you with restrictions you report to your employer with the paper work. Our light duty consist of sitting, doing paper work that the clerks should be doing and running to get lunch and soforth. all it does is make sure you are not sitting at home collecting a check. not sure exactly what EEOC is someone just sent me a link I am going to check it out and I will let you know. Maybe lilly can help you she sent me the link

rhomes...what i mean by deadlines is that IW have to report all to the company, WC in a certain lenght of time. We then have to see (at least in my state you do) a Dr. of the employers choosing in a timely manner. We have x amount of days to do all this or we create a bigger mess than we already have. In order not to be terminated I have to send my employer every 6-8 weeks an out-of-work note. Now take the IC. they can stall everything with no reason and DO.They take all the time in the world to pay us, give authorization to have tests done, surgeries done. I say it all the time . They have rights and we don't. My IC's attorney lied to obtain a depo. He has lied more than once and then changed the wording in his sides depos to suit himself. If an IW did that we would go to jail for perjury and fraud.

To date i haven't missed any appointments. In Ca. or rather with my co. you do need to send in a doctors report every 30 days period. My problem comes in that I went out sick in march I had already done light duty for 30 days because of my foot. We are allowed after 30 days to seek our own doctors. After 30 days I went to my own doctor and he took me out TTD. In the meantime I have several other injuries that I thought were going to settle, so the attornys sent me to an AME in either Dec. or Jan. Well when I got ready to go back to work from my foot in June my job informed me that the AME had put me as disabled to do my job so they refused to let me return. I went back to my doctor and he kept me on TTD.So far the only problems I have is getting back to work I don't understand the problem since until my foot in feb. I have been working at least 60 hours plus per week for the last 4 years since my knee surgery. I don't even know if they will let me do light duty now until I retire. But I am going to call my union rep and see if I can. In the meantime my lawyer sent a letter of dispute to all concerned stating that the doctor never examned me to make this decision. It's so confusing I hate typing long drawn out post but there is so much to my story I get confused sometimes. I don't even know which injury they are saying is making me disabled, shucks I have been in pain for so long I have learned to bite the bullet and keep working on the really, really bad days I use my FML. Plus by having a union they can't just fire me, but I can only be out sick for one year and then they can try to start the process of termination.
