Inpainokla-- your question scares me. I haven't worked since Feb 10th 2009, did work 1 and 1/2 day in April 2009 before they did an MRI and found out my first surgery failed. Then I was terrminated in Oct of 2009. Would my unemployed status start on Feb 10th or when they termminated me in Oct. I have never considered any of this until I read this thread.
6/97--Discectomy L5-S1. 3/09--Discectomy L5-S1 (failed). 6/09--spinal fusion L5-S1. This year who knows? |

Each State is different on the issue, just like Work Comp is. It is up to the person seeking these funds, to make contact with these Local Agencies, and simply just ask them your question. Your going to get your answer, and it took about a whole 3 minutes. It is that simple.

In many states the quarters they use to calculate unemployment is based on when you apply for benefits rather then when you draw them. It may be to your advantage to apply for unemployment well in advance of when you expect to be put at MMI in order to lock in the earlier earning periods.
don't assume unemployment will be there; contact them now and plan for your future. |

Something I learned through my WC claims. My first one I collected a WC check. MY 3rd I was out for 4 months and collected a paycheck BUT each WC check I rec'd I had to reimburse my employer.I did this so I would lose no seniority. Also through this time all my taxes, pension, UE tax, medicare tax was all being paid. My employer was actually losing money because all they were getting was 66 2/3 of my gross that they were actually paying. I never lost any time towards UE because of this. Sounds complicated but it wasn't and I doubt too many employers would do this. I also lost 3 1/2 sick days for every 10 I was out. Having over 100 sick days also helped the situation.

Good luck getting to speak to anyone at Unemployment Agency. If your state is like Kansas you will be on hold for 10 minutes or more just to be told there is too many people holding please call back later. If you do get through you better be prepared for at least a 40 minute wait time. Much longer than 3 minutes as quoted earlier.. Unemployment is not there for me in my case Kansas.

i dont know if your refering to me ecvq28dh..i did have a 2 level fusion dont remember exactley what it was called but ive also been told im to really to young at 30 and would prolly waste my time
