i am in Ny and was just wondering how SS calculates what you would receive if you did get SSDI. If you were to get a settlement or just still getting weekly comp checks have an effect on anything?

They will offset payments from comp up to 80% of earnings.

1171 is very correct.

What I did when I was approved, I went to the SS office, and I requested a low amount, lower then the offset from the comp checks. You will get this money back some day also, I did. Then when comp cut me off, and I was free of them, I sent in a letter and copy of last check from comp. The next month or two, I got all the back pay from date which was about 2 1/2 years back back pay. This was a large sum of money might I say. I've been told to do that way, to avoid any over payment, that would not have to be paid back then. it all worked out for the good in the end.

I am in NY also. I think providing both SSDI and workers comp payments do not exceed the 80% of which you were earning before you were injured you will get them both without deductions. So if you earnings were 1000.00 per week before the injury then your SSDI and WC checks cannot exceed 800.00. at least that is how I think it works. There are also 2 different types of SSDI payouts not to confuse you (because I am ).

You will only get what you put into it. If someone has worked off the books all their life and never paid into Social Security then he or she would not be entitled to anything.
