second opinions
i live in louisiana, and have been on worker comp for a couple years
now attending a local pain care clinic with no results was sent to a surgeon and i have put it off because i really dont want a foreign object placed in my back i have asked for a second opinion and workers comp has refused i do not have an attorney my question is can they refuse to let me or pay for me to see another dr. |

Second medical opinions as you wish have to be paid for by you. The Insurance now, can send you to one of their IME doctor's, but that doesn't mean the opinion would be what you wish to hear.

Here in MI. I believe after 10 days you can get your own doc. I did, in fact the ncm informed me of this. And yes they did pay for it. However your state may be differnt but worth checking into.
just another day in the life. cervical fusion c5-c6-c7 in 2005 reinjured in 2007. michigander. |

Hello everyone. I'm in La. South. Form 1008. Dispute. Change of choice of physician in different field. Who is your primarily physician? Were you referred to this pain clinic by him/her? If you summit the form 1008, in dispute of there's Dr.'s report. The w/c court judge would assign an IME to examine you. Unlike other's on this forum, La. has an complicated system. I may be wrong, but there is someone else from the Banana Republic on this forum who knows more.-Freebird-(didn't mean to point you out Freebird) but you have had better luck than I. All I can say now is to get an attorney if you don't have one. Hope this help a lil.

My Attorney went to the Louisiana state supreme court over WC refusing to do a surgery my First choice Doctor literally begged WC to do. I had two IME's by WC appointed Whore Doctors. This took over 6 months and my split vertebrate actually healed abnormally but WC was not held accountable because of the No cause of Action umbrella over there head in Louisiana. I firmly believe I am disabled today because of that denial above but We sued and lost. They can do what they want medically as long as it does not kill you. What part of the back is injured? When was your Injury? Have you been declared MMI? Have you had a FCE? I have a cage in my back. It did nothing for the pain but I had a split vertebrate. My Doctor said I could live without the cage BUT no promises 5 years down the road. Anyway...... 2011 Lexus Convertible |
