Question compensation


I fell at work in Maine on December 22, 2005 on ice that had not been sanded. I landed on my shoulder and after various procedures (Needles, therapy, x-rays and MIR) I had surgery (March 21, 2006), they found bone chips and bone spurs which were removed but no torn rotator cup. Then therapy sessions for 3 months. The final verdict is that I lost 5% use of my shoulder and 3% total loss.
Now, finally Workman's Comp has contacted me and is offerring me only $2,000 for future medical costs.
I feel that the pain and discomfort of the injury and operation plus having to be operatred on is worth a whole lot more. Any suggestions?

Yeah. That is totally REDICULOUS! That is nowhere even in the ballpark of what you should get for your future medial cost. Tell them where to shove it!!!!

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%

I feel the same way. I thought in the neighborhood of $30,000 would be something to consider.

I wouldn't even begin to think about settlement until you have talked to your primary care doctor to get their poinion of what may still need to be done. You dont HAVE to settle at all, no requirement.If you are at MMI then you probably won't recieve any more pay from WC, but medical should be covered as long as you have problems. It's been over a year after your surgery, and that's what most ortho doctors say it should take for a sholder to heal after a surgery like yours.
On the issue of money, i can't answer.

pain and suffering are not applicable to work comp. Workers' comp is not based on negligence law; it's "no fault" and benefits are set by law.
