DOES THIS SOUND RIGHT
I WAS AWARDED TEMP DISB PAYMENTS WHICH WAS STOPPED WHEN MY CASE MANAGER SENT THEM A PAPER SAYING I WAS RELEASED TO WORK. I WAS RELEASED TO DO SEDENTARY WORK - NO REPETITIVE MOTION - NO LIFTING OVER 10 LB. I WAS TERMINATED BY MY EMPLOYER BEFORE I COULD EVEN GET AN ANSWER ABOUT RETURING WHICH IS WHY I WAS GRANTED UNEMPLOYMENT COMP. WHICH I CANT COLLECT BECAUSE I AM NOT ABLE TO WORK. I DO NOT UDERSTAND WHY I CANT COLLECT TEMP DISABIITY . IS IT BECAUSE I AM NOT EMPLOYED WITH THE COMPANY ANYMORE SO FAR THEY ARE DEALING WITH THE MEDICAL. I CANT WORK, I CANT COLLECT DISABILITY PAYMENTS, I CANT COLLECT UNEMPLOYMENT. NONE OF THIS MAKES ANY SENSE , IF THEY WOULD FIX MY SHOULDER I COULD GET A JOB. MY ONLY CHOICE IN WELFARE SO I DONT GET THROWN OUT ON THE STREET. I HAVE USED ALL MY SAVINGS . I HAVE AN ATTORNEY SINCE FEBRUARY AND STILL NOTHING. I ASKED HER IF I SHOULD APPLY FOR SSD ANND SHE SAID SHE WOULD HAVE SOMEONE CALL ME WHY HAVE A ATTORNEY, I DO NOT SEE ANY USE FOR THEM.
I AM NOT ALLOWED TO TALK TO WORKMANS COMP, THEY WONT ANSWER ANY QUESTIONS AND THE CASE MANAGER REFUSES TO TALK TO ME EVERYTHING IS SUPPOSED TO GO THRU THE ATTORNEY.
THE PROBLEM I HAVE IS I DON'T KNOW IF IT IS. TWO MONTHS AGO I SENT A CHECK WHICH HAD EXPIRED TO MY ATTORNEY TO HAVE REISSUED - I AM STILL WAITING TO RECIEVE THIS CHECK, AND CANT GET AY ANSWERS MY ATTORNEY SAYS THAT THE INSURANCE COMPANY WAS FIRST WAITING ON THE BANK TO REISSUE IT, THEN THEY HAD COMPUTER PROBLEMS, THEN SHE SAID I WAS MAKING THEM ANGRY WITH MY CALLS AND THEY WILL HOLD OFF REISSUING THE CHECK FOR AS LONG AS THEY WANT. HOW DO THEY GET AWAY WITH THIS

What kind of work did you do before your injury? They did not find you light duty work? I am awaiting the same thing right now as i am not able to return to my old job. I am curious if they are going to fire me or find me something. If they fire me i should still get workers comp right? I am also meeting with a lawyer on friday for a free consult. Should i go with a lawyer now or should i do this on my own? Now you have me wondering if it is worth it or not to get one. If anyone knows the answer to these questions please let me know. I live in NH. Thanks

RETAIL MANAGEMENT IN A BIG BOX STORE WHICH WAS UDERSTAFFED- MANAGEMENT HAD TO DO EVERYTHING AND BE ABLE TO DO EVERYTHING WHICH I WASN'T SO I WAS A LIABILITY TO THEM.
I AM STILL TRYING TO GET THE ANSWER ABOUT WHETHER OR NOT YOU WILL GET WORKMANS COMP. I AM NOT AND IT STOPPED THE SAME DATE I WAS TERMINATED.
AS FAR AS ATTORNEYS I DONT KNOW IMY ADVICE IS DONT GO WITH YOUR FIRST ATTORNEY, QUESTION A COUPLE ASK THEM HOW HARD IS IT TO REACH THEM, RIGHT DOWN YOUR QUESTIONS AND DEMAND ANSWERS---
WHOEVER ANSWERS THEM QUICKLY WITHOUT USING EXAMPLES OF OTHERS CASES GO WITH THEM. MINNE GAVE ME NO INFORMATION BUT MADE IT SOUND LIKE THEY WANTED TO HELP. I WAS WALKING INTO THIS SITUATION BLIND AND I FEEL I PUT MY TRUST ITO SOMEONNE WHO IS WORKING WITH THE INSURANCE COMPANY NOT ME.
I AM LOOKING INTO OTHER ATTORNEYS WHICH IS AN ADDED STRESS I DO NOT NEED.
THE LAST STRAW WAS JUST NOW I WROTE THEM ANOTHER EMAIL WHICH WAS THE 5TH ONE SINCE 7-06 CONCERING MY THERAPY. I JUST GOT THE ANSWER BACK THAT THE DR. OFFICE HAD TO CONTACT THE INSURANCE COMPANY. MY DR OFFICE DID CALL RIGHT IN FRONT OF ME O THE 6TH AND THE CASE MANAGER SAID SHE DIDN'T KNOW ME . I IN TURN GAVE IT TO MY ATTOREY ASSUMING THEY WERE GOING TO HANDLE IT - THE ANSWER I GOT BACK TODAY WAS THE CASE MANAGER WANTS TO DO EVERYTHING SHE CAN TO HELP WITH MY INJURY YET SHE IS PLAYING GAMES. IF I DIDNT HAVE AN ATTORNEY I MIGHT HAVE BEEN ABLE TO GET TO THERAPY TWO WEEKS AGO.

SORRY I HAVE BEEN NO HELP BUT I AM LOOKING FOR ANSWERS TO

If you are terminated because of no lite duty, And depending on what your restrictions are, You can then apply for unemployment, but must look for work within your restrictions. You can not collect unemployment and WC at the same time. Hope this helps

When I applied for Unemployment here in Illinois, I was asked to have a letter from my treating Dr stating my restrictions, It was basically a form letter I had to take to my Dr and then sent back to unemployment.

I WAS AWARDED UC BUT I CAN COLLECT ON IT BECAUSE MY INJURY DOES NOT ALLOW ME TO WORK WITHOUT RESTRICTIONS/ MY DOCTOR HAS FILLED OUT THESE FORMS EVERY MONTH BUT CANT RELEASE ME UNTIL I HAVE THE SURGERY DONE. I AM NOT COLLECTING WORKMANS COMP ( I DONT KNOW WHY) AND ON TOP OF THIS I JUST GOT A MESSAGE FROM MY ATTORNEY THAT I HAVE SENT THEM TO MANY EMAILS ( I HAVE WRITTEN TO THEM 25 TIMES IN 5 MONTHS. 6 OF THEM WERE ANSWERING THIER EMAILS- 3 WERE SEDINNG THEM IFORMATION THEY WANTED. I THOUGHT IT WOULD BE QUICKER THEN WAITING UNTIL I GOT SOMEWHERE TO FAX IT PLUS IT DIDN'T COSTS ME ANYTHIG TO SCAN AND EMAIL IF THEY RETURNED MY TELEPHONE CALLS I WOULD HAVE EVER TRIED TO WRITE. WHAT A MESS NOW I HAVE MY ATTORNEY MAD AT ME SO NOT ONLY DO I NOT KNOW WHAT IS GOING ON NOW I AM AFRAID TO STEP ON THIER TOES.

I hope you are considering getting a new attorney!!! They work for you not the other way around.

So you are still being treated by your Dr, for your injury, and can only work with restrictions, but lost your job, is this right?

Then I would think that your attorney should have filed something to get your WC benifits reinstated.

You wrote can collect UC, I think you ment Can not collect. So in other words your employer said you could collect unemployment but UC says no.

YES I AM STILL BEING TREATED BY TWO DIFFERANT DOCTORS ONE FOR MY ARM AND SHOULDER AND ONE FOR MY NECK. I HAVE RESTRICTIONS AND I AM AWAITING SURGERY I HOPE THIS YEAR SOMETIME -- CANT GET ANY ANSWER FROM PRESENT ATTORNEY - I HAVE TO GET SOMEONE ELSE - I HAVE BEEN TRYING TO RESEARCH THIS- I HAVE HEARD A NEW ATTOREY WONT TAKE THE CASE WITHOUT YOUR FILE AND YOU CANT GET YOUR FILE WITHOUT PAYING FIRST ATTORNEY. SINCE I HAVE NOT RECEIVED ANY MONEY IN 5 MONTHS I HAVE USED UP ALL OF MY SAVINGS . I AM STUCK BETWEEN A ROCK AND A HARD PLACE.

I have never heard of paying off the first attorney before retaining another attorney, usually the first puts a lien on any settlement you receive. There are others here that may know more about this issue, Like Still in Limbo, or others. If it were me I would be looking high and low for a new attorney as it appears the one you have now is not looking out for your interests.

It may be that you can look also into some sort of state aid, I don,t remember which state you are in?

Good morning all......I always suggest when an IW is not happy with the answers they're getting from thier attorney or having a terrilb etime even getting an answer or call back that you schedule a face to face appt. with the attorney with a list of questions and concerns you have. If that doesn't help, go in search of a new attorney. Tuffy is right. IF there have been more than one attorney involved all get a piece of the settlement. That's why it's so hard to find a second attoreny. They are not getting the full %. I could be wrong but I beleive the courst have to approve a change of council. I went on my stat'e WC website years ago and sent them an e-mail asking this question. "what do you do when your attoreny is not working for you and you feel you need another attorney" the answer I got was they needed more info and felt it was a legal issue and not their's. I never had to go further so I'm not positive of what it takes to change attoreny's/
