Thanks so much for all the support. I have an appointment to meet with a new attorney tomorrow. I called 5 today and am going to be really nosy tomorrow and ask a lot of questions when I meet this one and if he doesn't know the answers to my questions I will just keep on trying. It feels so good to have a plan............

I will be in need of a medicare set-aside when I finally settle my case. I have had 2 back surgeries the latest a 3 level anterior/posterior fusion with instrumentation last November. I am in pain management and will be for a long time still having severe burning pain in my feet, legs, back arms and hands. My monthly drug bill is over 1200.00. I am 53 and on SSD already. My medical bills for the past 3 years are over $400,000. What if they put for example $400,000 in a set aside for future surgery and drugs. Let's say 5 years go by and I don't need any more surgery. What happens to the extra money in the account? Does my beneficiary have to wait until I die or can I petition the court to reduce the amount in the set-aside with a letter from the doctor stating that I won't need any further surgery?

That I'm not sure of. Best to check with the SS Office for that question, I only know how they distribute the funds, I'm not sure about closing the account out early but if I had to guess, they would probably give these extra Funds back to the i/c. They are set-up for Medical during the Lifespan of the i/w, and if the Medical is not going to be used, I don't see them letting you close it early. Just my opinion, you may want to check!!Wink

We're talking Medicare Set-asides, Company Pensions are one thing, but set-asides are a part of the language of your settlement, and I'm not sure they are allowed to be paid back, Medicare is the Federal Level of Govt. and you don't want to get caught defrauding Social Security!!Wink
